Subject: immigration: CBSA
  i am an immigrant that will soon face deportation. i am having trouble with the cbsa immigration officer. i recieved my court letter dissmissing my appeal for a second hearing. the date on the letter was sept 8. i recieved my letter sept 12. the cbsa is telling me that i have to leave sept 29 because thats when the court decision was made. i am confused about the date. which is my last day in Canada? My CBSA officer is being very rude and not helpful at all. she has raised her voice at on every occation that i met with her. She also keeps changing her information that she has given me. For example, she informed me to give her a four day notice as to when im leaving but today she has told me to give her a 10 day notice. My daughters passport has exipred and im waiting for it to be renewed which should take two weeks to receive. please help me!

The fact that you allowed your daughter´s passport to expire during your process is still your fault. Nobody else BUT yours.

You are being told to leave Canada by September 29th and what that means is that you have to leave Canada by Sept 29th no other way around it. The officer wants to know when you are going to leave Canada.

The fact that you don´t have a valid passport for your daughter is not really CBSA´s problem. That is between you and your embassy.

The fact of the matter is that you are required to leave Canada by Sept 29th. If you are still here by then, as the officer probably mentioned before, your departure order will become a deportation order agains you and that particular officer is willing and going to enforce it.

So, no excuses and put a rush in your passport. You are better off leaving and following the rules and getting CBSA to deport you. It is not pretty and it will make your chances of coming back to Canada (if that is your interest) harder in the future.

The problem is that i did not know about the passport since the CBSA had the passport. And the court decision was made on 29th of August, but we received it on 8th of september, so which date should i consider, since the officer the first day told me that we should consider the 8th of september and then in the secod appointment she informed us that was 29th of August, i was willing to leave Canada on 4th of October, so before the deportation day 8th of September, And another issue is that we have a humanitarian case in process.DId they still have the power to force us out of the country?

The officer should have explained to her clearly... isn´t that their job to do that? Even if it is her fault that her daughter´s passport has expired, still, the officer should have clarified her doubt... When you have a departure order against you, you will be too distraught... too many things have to take care e.g closing bank account, pay outstanding bills, making arrangement to go back to home country etc.

For whatever reason, the office should not be rude...

You are required to leave Canada by the end of the month. An H&C application is process WILL NOT prevent your deportation.

Bank accounts, paying bills etc that is between you and the financial institution. Those companies have nothing to do with CBSA.

A departure order is valid for 30 days after the day when it was issued, after 30 days becomes a deportation order period. I don´t know what to tell you, there is no way around it.

The CBSA Officer has to be alive, alert and sensitive to the Best Interest of the Child.

Please don´t listen to any CBSA person who is impolite ask to see their supervisor or retain someone who will stand up to CBSA.

Yeah, follow Roy´s advice after you were given a departure order that it becomes a deportation order after 30days and let me know who it goes for you.

Wow!

Like a Self agrandising/self promoting, egotistical or arrogant, rude, media whore, unethical wind bag of a consultant doesn´t exist either. Hmmmm????
Must be a thing of fiction?

I must be thinking of another person who loves to hear the sound of thier own voice.

I don´t know if DocD would agree, but I have a feeling a lot of people have extremely limited understanding of how immigration works. So when complicated things are being explained to people (especially ones who have very limited formal education), and people who are upset, I can imagine that they retain very little of that explanation and for whatever reason say they understand, but the momment they hang up the phone, realize they got all the details wrong. Then go on a forum and say that the CBSA got all the fact wrong. Possible, but it´s all possible the original poster was so distraught and confused (was there a language barrier?) that they misunderstood what was happening.

In regards to being rude.....let me ask the original poster this: If an Officer has explained to you calmly and clearly what you have to do, but you keep replying "I can´t" "I won´t" "It´s unfair" , or in some cases there must be client´s who say they will do something but over and over they have shown that they are dishonest and are more than willing to milk and abuse the system, and then the officer raises there voice with you after that kind of a situation, what do you expect?

You´re possibly being unrealistic.

Hey, the other day I spat in a cops face when he was handing me a ticket for driving double the speed limit. The cop started shouting at me and then wrestled me to the ground and hand cuffed me. The nerve!
