Subject: Info on Canadian Immigration.
  I live in Los Angeles for about 15 years and I tried to get my document in the USA but I wasn´t succesful and now I´m thinking of applying to Canada. What I want to know is that my being here in the USA illegally would have bad case in Canada? Can anyone tell me how is the best thing to do?

yep, because you live without document, how can you prove you are legally resident in U.S, how can you obtain police clearance letter from U.S?

During the process of my documentation I was able to get a work permit wich I was able to get for 3 years. I was able to get a social security number plus a California Driver license/ID. I can get a Police Clarance from the USA. Besides, I don´t have a record;nothing serious though.

there is criteria that you must have arrived in the US (or any other country) legally to be considered for Canadian immigration. There is much debate about what happens when legal turns into illegal. Some are saying Canada disregards but we cannot be certain. Regardless, you are still obligated to provide all the same documents that everyone else does - such as FBI clearances and employment records. If you are able to do all of the above, then I would suggest it is worth a try. The only other option you have is to find a place where you can be legal upon application - likely your home country.

I am sure you next question will be... is there a chance that the US will be flagged that you are living illegally? Perhaps but it would likely come from inside the US system. From what other posters have suggested, Canada is not sending the US a list of who is living in the US with expired visas and permits.

My partner is illegal here in the US. We applied for the FBI certificates and there was no problem - so you shouldn´t have to worry about that. I´m not the expert, but as I understand the rule....You have to show that you were admitted legally into the country where you are applying for a period of at least one year. Since you were admitted legally and had a visa for 3 years, that should be OK. But then again, this is only my interpretation. Buena suerte!

This is directly from the OP1 Manual (in reply to: Info on Canadian Immigration.)
"5.18. Applications from illegal residents
R11 stipulates that applicants cannot submit applications for temporary or permanent resident
visas outside of their country of nationality, or, if stateless, their country of habitual residence, to a
visa office in a country where the applicant has not been lawfully admitted. Therefore, visa offices
should return applications, plus any accompanying documents or fees, if they determine that an
applicant was not legally admitted to the country where the submission was made. Applicants
should be counselled to apply for a visa to a visa office where they have been lawfully admitted for
at least one year."

I email the Canadian Embassy in Mexico City about this matter and they replied that I have to file my documentation in Mexico, and it would be evaluated there.
