Boyfriend is being deported

Subject: Boyfriend is being deported
  My boyfriend has no status in Canada, but didn´t take any proper steps to address the issue, overstayed, and has now been caught and is being detained. He believes that he is being deported and there is no point in wasting money on an immigration lawyer (he is waiting to hear back from legal aid). He was told while detained that he had the option of submitting a PRRA, which he did which he now wants to retract as it won´t really help and will only delay things. Is there anything we or an immigration lawyer can do at this point, or has he ruined any chances by overstaying illegally? (He has been here without status over 6 years). Is there any chance he will ever be able to come back to Canada after going through this process?

my advice would be for him to go home voluntarily if that is still and option and if you have been living common law for more than a year... begin a sponsorship application. If you have not been living common law for that long, you will need to be married before you can sponsor him - ASSUMING you want him to remain in your life.

6 years out of status, illegal in Canada.

Exclusion order, one to two year bar from coming to Canada.

No refugee claimed, must be done before removal order issued.

PRRA submitted. Now wants to withdraw knowing not flying.

Any chance to have him come back to Canada?

Sponsor him from oversea. If the visa office requests things such as Authorization to return to Canada (ARC), submit it.

Thanks for the replies. I really appreciate it, this is quite overwhelming to figure out.

The immigration officer at the hearing said it might be a deportation order, so I am not sure if leaving voluntarily will be an option. I am thinking I should at least go talk to a lawyer because a deportation order would be devestating, but I don´t even have any of his paperwork.

I have finally just today got the name of his Removals Officer, and am trying to get in touch. Will the Removals Officer be able to help me get his paperwork? I have nothing right now that I could even bring to a lawyer.

Be careful to what Anonymous is telling you. It is not really true.

If he was detained, likely there is a warrant against him. Which it means that a previous volunteer departure or a previous exclusion order was issued, he didn´t comply and now has become a deportation order in effect.

The PRRA is a waste of everybody´s time at this point and he knows it. The removal´s officer has to stablish his identidy and gather his passport so he can ship him back to his country of nationality.

It is very little to nothing what you can really do at this point. If both of you are in a commited relationship, then there are some other channels that you can use to bring him back to Canada in the future. It will not be easy but doable.

You have to accept the fact that his deportation is imminent and it is matter of when.

If you are truly, genuinely in love with this guy and can´t live without him, I have a very practical suggestion: Please go to his country soon after he is deported, marry him there and live with him. His love to you and your love and respect for him should keep you both in good health. He can easily pursue work there since it is his native country; meanwhile, once married, you can explore work opportunities there; once both of you start working, you can slowly make plans for future return to Canada.

Thank you all for your advice, you have been very helpful. I was finally able to speak to his removals officer, and have booked a consultation with an immigration lawyer to go over the case in more detail.

I appreciate everyone taking the time to respond, I have a much better idea of what to expect and what to do now.

I am particularly impressed by the compassion DocD showed. well done DocD.

What every one must understand with long term overstays it is normally because of lack of employment in these people native countries that they come to Canada in the first place.

Normally these types come from Visitor Visa exempt countries, like Portugal, some Caribbean countries and probably soon Greece. Not real Refugee producing countries.

Going there and remaining there and hoping to get employed is not a real option especially if your established here.

Most men if they care for the girlfriend will be very hesitant to ask for their girlfriends hand in marriage for one simple reason. They do not want their girlfriend who they love to think that they are just using them to get status.

when you consider marriage it has to be for all the right reasons.
