I´m not sure whether you are joking or you do have a serious question. But here are my thoughts

Depends on a whether you´re an American citizen or not.

If not, then the Canadian Govt will consider whether you are able to return to your home country or not, without fear of persecution.

If you are, then the Canadian Govt. will consider whether you have a well-founded fear of persecution for reasons of race, religion, political opinion, nationality or membership in a particular social group. At the political level, the Canadian govt. does not view the US govt. as being a violators of human rights. Therefore, if they do accept you as a political refugee, that would tantamount to calling their close ally, a country that violates human rights.

You might have had a better chance of getting political asylum if you were a draft dodger during the Vietnam war era, or you fear getting the death sentence for crimes committed in US. However, I doubt whether you will be granted asylum solely on the fact that Pres. Bush is getting re-elected.

This seems to be working. THere are few cases that I hear who are applying based on that. I think it perfectly makes sense. You might need a legal advice though.

What if you feel that as a US citizen and a homosexual, your rights are being violated in regards to marriage and partnership legal status with such issues as hospital visitation, partner benefits, inheritance, etc.

I guess I am not the only one looking at this option. Should this become a necessity, could anyone direct me to the appropriate Canadian gov´t web links to find out how to go about the asylum process?

Thank you / Merci

While I am no legal expert, and currently am an American citizen facing no direct threats of physical harm or intimidation, I cannot believe that I would not be given an opportunity to choose to live in a country where I will feel free and safe as a woman and as a liberal. My parents may not have followed through on their desire to become Canadian citizens during the Vietnam era, but I am seriously considering it now- but if it is not an option in Canada, does anyone know of other countries in the Western world that have (or are willing to) set some sort of precedent in this area?

I am currently researching this option particularly for my children who I fear will face unspeakable atrocities due to rising debt and what effect that will have within our own borders and on a global scale. I think that US policy will continue on its track to ablolish the middle class and if that is not a human rights violation then i am not sure how else you would fail to define it.

I´m also considering applying for political asylum in Canada as a lesbian with a partner and child whose rights are clearly in jeopardy as a result of Bush´s reelection.
Any information on this would be much appreciated.

Diane--

I am sorry that you fear for the safety of your
family. Isn´t it ironic that the party of "family
values" actually threatens families? We are in for a
sad time, I´m afraid.

I haven´t made too much headway through the maze of
information available. I did find a website at

http://www.cic.gc.ca/english/refugees/index.html

I haven´t quite figured out what all the legalese
means. I do have friends "up there" that will sponsor
me and my partner, should bad go to worse.

Please keep me posted if you find any information, and
I will do likewise.

Asylum in Canada (in reply to: Political Asylum)
While fear of persecution and human rights violations may not be reason on a personal basis to accept ex-patriot Americans, does anyone know of a case where an immigrant candidate has appealed to Canada for asylum based upon the US as a government voilating others human rights, in Iraq for example? In other words I am not necessarily afraid for myself as much as I need to completely separate myself, for ethical reasons, from my tax dollars being used to kill in the middle east. WOuld it help to go to Canada and refuse to leave?

which comes first? (in reply to: Political Asylum)
Hi - I´m new to the site. I have a simple quetion. Which comes first, the work permit or the job? I have read conflicting information where on the one hand, it seems you need a work permit to get a job, and on the other, you need a promise of work to get the permit. Which is it?

Thanks for any help -
