Removal order and Sponsorship application

Subject: Removal order and Sponsorship application
I would like to know if there is a removal order been issued to leave Canada and at the same time there is an ongoing sponsorship application. Will this removal order cause the Sponsorship application to stop until it is resolved? Any comments is highly appreciated.

If the Spousal Sponsorship application was received before the applicant was called to a Pre Removal Risk Assessment the removal will be deferred.

This is Public Policy.

As long as the person concerned did not do something to prevent his removal or only came to the attention of CBSA/CIC by a Police Investigation.

Thanks for the reply.

The sponsorhip is mother/daughter situation and is not spousal. So based on what you say, the permanent visa application can not be stopped if the sponsorship application was submitted prior to the removal order. In this specific case, the application was submitted to the overseaes CIC office in 2003 and the removal order was issued in August 2011. The passport was requested by Canada Immigration in order to issue the visa, but when the overseas CIC office found out that the removal order is issued, the passport was shipped back to CBSA office in Canada. Is this procedure legal or they are in violation?

This summary is based on speculation only:

An oversea PR application to sponsor a mother was submitted in 2003.

The mother came to Canada on a visitor or student visa.

Inadmissibility and a removal order in August 2011.

The applicant is inadmissible to Canada until such and such a date.

You have to be clear Sam.

Is the Mother sponsoring the daughter or the Daughter sponsoring the Mother?

Either way there is nothing to stop them from removing the other.

On what basis was the removal order issued? (overstay)?

Hey Roy, Here is the detailed explanation of the situation and any comments are highly appreciated. Mother lived in Canada nearly 10 years. Daughter sponsored her for permanent visa. Since the application process took a long time, she decided to claim for refugee status. Her refugee claim was denied and subsequently removal order was issued. The sponsorship application was in process when she had claimed for refugee status.
After the removal order was issued, CIC asked for her passport in order to issue the visa. Until the CIC found out that there is a removal order for her and they sent back her passport without issuing the visa. The sponsorship application came to halt because of this. My main question is "Does this removal order stop the sponsorship application process?" Also will the removal date from Canada be deferred until the result of sponsorship application is known? As per CBSA, the best way to get the permanent resident visa is picking it up from the overseas CIC office where it will be issued. Due to the health condition of the mother, travelling overseas will be very difficult. Is it possible for the visa to be issued in Canada instead?
