H&C processing time

Subject: H&C processing time
I applied for PR on H&C basis in Oct, 2010. My file was trnasfered to Vanouver on Jan, 2011. How long will take to get First Stage approval?

Hi Hafif, I have the dame time line with you. I applied September, 2010 and my file was later transferred to Vancouver in January,2011. Later in July,2011; it was transferred to Montreal, stating that Montreal have 12 months time line to process my application for the first stage approval.I think Vancouver is really back log in coordinating the the entire net work of H&C and PRRA. They just open the files and transferred them to other BRO offices.I am sure the experts like Docd,Roy and Sharon could throw more light on this matter. They live and earn for this matter---lolz. I was told before next yesr july, i may get a decision, but when; they are not sure. You can call the call center and ask which office is holding your application at the moment.

@stephen, Thnks for ur reply. Actually I called them today and they call centre agents say that it is in process, which they usually say. I talk to my lawyer, he told me that u might get a decision in july august of 2012. Honetly, speaking I can even spent a second without thinking about my application. I hope at the end of the day we get a positive result.

@Hafif,Thanks for the information as well. It doesn´t really tell if it will be July/August next year, but it could be anytime from now. It depend on case by case and the office that is processing the application. I have seen someone that applied in 2009,and got approval before people that applied in 2005.So do not be despair,the better day is coming our way.Just keep updating your files as anything positive comes up in your life before your decision is being made. The more you keep updating, the better for your application. Have faith and keep praying to God.We should be happy that H&C is now in a rocket state, compare to the olden rules that people don´t have a specific timeline.

best interests of any children affected by your application (see following section for more information)
health considerations
family violence considerations
consequences of your separation from relatives,
factors in your country of origin (not related to seeking protection)
any other relevant factors you wish to have considered that are not related to seeking protection.
The best interests of any children directly affected by the decision made on your application will be taken into consideration in the assessment of your application.

Factors related to the best interests of the child may include but are not limited to the:

age of the child,
child’s establishment in Canada,
conditions in the country of origin that could impact the child,
medical needs of the child,
child’s education, or
child’s gender.
The best interests of a child do not outweigh all other factors in a case. The best interests of the child are only one of many important factors that will be considered by the decision maker.

WOW Stephen you can copy and paste the IP5 H&C manuals. So?

DocD makes no money from assessing H&C applications he works at a POE port of entry.

Sharon makes no money from assessing H&C applications she works selling umbrellas in Vancouver.

Roy (me) wins H&C applications and can prove same. Please do not refer to me as an expert I really dislike that word. I have much more to learn.

Now regarding your personal H&C factors.

When Anonymous **.232.244.253 asked what are your guys H&C factors I expected to see a substantive answer. I did not expect to see a copy and paste blanket answer and he or anyone could pick what ever was appropriate.

When someone asks what´s for dinner and the reply is (meat), what does it mean?

So what (actual) H&C factors were not intended by the Immigration Act and IRPR Regulations and beyond your control? Which hardship is unusual, undeserved or disproportionate? What common sense evidence do you have to support those factors?

No one knows when the BRO will assess ones H&C application or for that matter when any local office will assess an H&C application.

Having an H&C application (in process) will not stop ones removal.

Blanket H&C applications with little if any substantive issues that the average Canadian would view as common sense is just a waste of money and time.

Hi Roy, I understand what you meant by copy and paste. I am not a immigration office neither a immigration lawyer. I only use part of my knowledge that I´ve acquired during my hard time with the CIC. You guys have much experience and that was what i meant. At least i copied and paste;showing that i still have little knowledge of what factors they are looking for. I gave him series of the list and its up to him to make good use of it. There is a new amendment to H&C, meaning they do not look into risk and torture again; but partially this could still be considered as hardship in a common sense manner. So i do no mean to mislead whosoever. Thanks you for coming in to make your own opinion, and like i said prior; that the decision could be made at anytime, but just telling you what the time line in Montreal at the moment.

@Anonymous [**.232.244.253], this thread line was to justify the current time line about H&C. The question came in between asking what factors we used for filling in our application. It is obvious that some people come up here to distract or go against whatever people say or said. Before i commented anything on this thread, i remembered vividly telling Hafif to ask Roy.DocD and Sharon for better advice. I do not work with immigration my people, so don´t get the issue twisted. If i can, then why didn´t you provide any little of assistance rather than jumping on what i wrote or said. I do not work with immigration and they´ve make changes to H&C since i applied last year. Knowing that hardship is unusual, undeserved or disproportionate is what they are looking for. still i respect everyone on this thread and am not going to make any negative comment about anyone. so you can give the factors to him as well. Roy you really need to grow up from your childish attitude. You´re an old folk and i don´t mean to disrespect you in any form. You are not my lawyer and i don´t see any reason why you should be going against people here you old fool!!!
