Subject: Roy Could you please help!
  Hi everyone!

I have one question, my family and i were acepted under h&c grounds.
My brother was charged with impared care and control, and was convicted, 6 months suspencion and 1 year of some kind of rehabilitation,.
Now my question is this. We are a family of 10. So we are going in january for our landing interview, would his inadmisibility affect all the rest? I have heard, it does but i was reading in the cic page that in some cases the pr woulnd be issued only to that person. But im confussed :(

( you might want to know, he was out with my husband and i and we went out i was designated driver, and we stoped on our way back to eat something and i parked the car , because the place where i parked we could of got a ticket, he moved to the driver seat so the parking police see someone there, as we went in, the police was passing by and saw him sleeping( i forgot the car keys in the ignition) so he was arrested, and since he had no more money to pay the lawyer he accepted his plea deal. As some of you know it doesnt matter if you are driving or just parked , you´ll be charge anyway!

The landing officer will ask at least one of these questions,

Have you ever been convicted of a crime or offence in Canada or outside Canada?

or Have you committed any crime ( a general one asked to a family who were at the landing interview)?

You will be duly informed how this will affect you and your family members.

Was your brother convicted after submitting a RCMP fingerprint? If your landing interview is slated for the month of January, 2012, it is best that you informed CIC as soon as possible or visit in person a CBSA office such as GTEC in the GTA area.

Hope that you keep us posted with the follow-up.

Was he conditionally sentenced? Hence then no conviction.

They can issue a Temporary Resident Permit to overcome the inadmissibility.

I find it hard to accept your story. You stopped for something to eat and he stayed in the car, moved the car and fell asleep.

Anonymous yes this was after the fingerprints.

Roy thanks for your time, and he didnt move the car he just moved to the driver seat.

Roy one more question.

If he gets the TRP will he get it right there and then? Or will the file be sent to the officer who was in charge of the decision?

Anonymous advise does not make any sense. That is not the procedure.
Show us in where does it say that in the operations manual.

What the hell are you talking about?

What TRP? do you really think that someone can just say....I HAVE BEEN CONDITIONAL SENTENCED AND I NEED A TRP TO OVER COME IT?

At this point he is inadmissible PERIOD. Whether the sentence was conditional or not. He has been charged. Read the application.

He is going to have to declare it in his interview and that will star another process.

TRP just to over come his charge? LOL

Yeah right. Which officer is going to sign that one?

At his interview he has to declare it. Then the CBSA will fill a couple of forms and then they will take it from there.

Hi Roy,

I am emailing you on behalf of mother in law whose Humanatarian & Compassionate Grounds application was denied by CIC. Originally she came to Canada from Jamaica in 2008 and filed refugee in April 2008. Refugee was denied October 2010. After this was denied she applied for H&C and last week was denied this also.

She has a 3 year daughter who was born here in Canada and currently she has a hole in her heart and the care for her condition would be better in Canada not in Jamaica where he healthcare system is lacking all that´s necessary for anyone´s survival. She does not want to be seperated from her young daughter and fears for her health. She also has a 17 year old daughter currently attending school and to have her taken out of school as she is about to graduate is not something she wants to happen.

My mother in law Novlett has established herself very well in Canada. She currently operates her own catering business which is pretty successful. She works full-time at an old age home and has never had to depend on the government for money.

Last week Thursday they informed her that her H&C was rejected and to come back this Thursday to get information regarding her removal. She´s scared to go back to Jamaica and has nothing to go to. Is there anything that can be done to keep her in Canada with her daughter?

Hello everyone

I just want to let you guys know that my family and i had our landing interview today, when we went the first time the landing officer sent the file back to the decision maker, she sent my brother a letter saying she is prepared to waive that requirement provided that he completes the back on track program and provides proof.. And that make me believe in humanity again , not everyone is coldhearted as some people here, So im very happy everything worked out i can go to university this year...

Im prepared to begin a new journey.! Good luck to the rest of you waiting, and to some that are starting this process remember retain a good counsel thats the best way to go! :)

The provision(section 233 of the Immigration and Refugee Protection Regulations, SOR/2002-227) operates only to stay a removal where there has been an approval in principle of an application for a Humanitarian and Compassionate exemption.
