Subject: PR Obligations not met, w/ expired pr in Canada
  Hi! Hope someone could help me.
I received my PR Card Nov 05 2005. I went back to my country and stayed there for 4 years. I came back here in Canada September 19 2010, few months before my PR Card expires. The immigration officer at the airport just asked me why i stayed outside Canada that long, i said i was studying, and told me that i have to renew my PR Card and she let me in(i was expecting something worse than that).

My PR Card expired last January and i have not applied for renewal until now. Am i illegally staying here in Canada right now?

Can I still renew my PR Card?

I would really appreciate your help. Thanks.

No - you are not illegally staying in Canada right now.

Wait until you have lived in Canada for 730 days (2 years) out of the last 5 years and then apply for a new PR card. Don´t leave Canada until you have met your residency obligation and applied for a new card.

Also, don´t apply to renew your card before you have 730 days.

You are not illegally in Canada. Technically you are still a permanent resident. Your status has not been revoked at least not yet.

You meet all the requirements for your status to be revoked. The advise that the person above my post gave you is not the greatest pretty stupid actually. That is cheating the system and there are a lot of people that are getting their citizenship and PR status revoked due to stuff like this.

Renew your PR card and if your status is subject to be revoked there are steps that you may take but hiding this under the carpet and trying to cheat the system is a very silly thing to do.

i think you are not anymore PR!!!There is a limit about how long you can stay outside of Canada to maintain your PR status.

DocD, thanks for your advice. But if i do apply for renewal right now, obviously my application would be rejected, right? What are my options? My pr card has been expired for almost a year now.

If you apply now - your application will fail. You don´t meet the 730 days in five year rule.

Again, your only real option is to stay in Canada without leaving until you have accumulated 730 days residency and then apply for a renewal.

Well it is a really warm day in December that I actually support DocD´s comments 100%

EVERYONE who is a permanent resident needs to comply with their residency obligations.

The rule is a PR must be in Canada 730 days out of (EVERY) five year period.

28. (1) A permanent resident must comply with a residency obligation with respect to every five-year period.
(2) The following provisions govern the residency obligation under subsection (1):
(a) a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are

The key word is (EVERY) and you claimed you were outside of Canada for FOUR years. Now what did you interpret four years to be?

I went back to our country. The first reason was to finish my college degree, which I had 2yrs left on that time. I was living with my grandparents then. But right before I graduated, my grandma became ill. I was tasked to be with them since almost all of our relatives were living outside the country. Then my grandma died and we found somebody else to attend to my grandpa which is sick as well. That´s the only time I got the chance to go back here in Canada.

I am aware that was not able to comply with the residency obligation. I just want to know my options on how can I apply for renewal, because now I am really planning to stay here in Canada for good.

Make sure you have a copy of the death certificate. Any statutory declarations as to you assisting your Grandfather.

Now if your not planning on travelling any time soon why even obtain a PR card. Are you from a CVV exempt country?

If you do not need a Visitor Visa to travel to Canada from your country the PR card issue is not a serious item you need to posses.

"Only practical, real option you have is to stay in Canada without leaving until you have accumulated at least 730 days residency and then apply for a renewal", as mentioned by earlier poster. Any other measure is likely to put you in trouble.
