Subject: Having my girlfriend move to Canada
  Currently my girlfriend of the last 5 years lives in the US and we´re looking to have her move here and get PR. We had already decided to get married, but aren´t sure if we should do it before or after she arrives. Preferably she would come here on a visitor visa and start the application in country, even though it does take longer as we´d rather not wait an additional year or more to be with each other.

What is the best way for her to come here to stay with me, through a visitor visa that we can extend each 6 months? Would it be better for us to marry there ahead of time or wait until she is here? Since the marriage will be close to the application date, is there likely to be issues with it? I do have proof that for the last 5 years we´ve both booked flights every couple months to stay with each other for weeks at a time.

the truth?

get married, she stays in the US while the application is processed, you continue to make your visits (chances are good she will have a tough time crossing the boarder once the application is started)

why?

1) its the rules
2) applications take less than half the time to process
3) both of you can continue working during the application
4) if something goes sideways with the application you have the right to appeal.

That´s what I kind of figured. The problem is shes not currently working due to lack of being able to actually find a job. The other problem is we´re not quite sure how long her current living arrangements will be available. I actually have a job available for her here with the company I am with once the process is all done with, the problem is it would be customer support work which doesn´t seem to qualify for any kind of work visa, that along with she doesn´t have any education in a related field.

until her application is complete, it is illegal for her to work.

You can try to have her cross the border and apply as if she is still residing in the US, but 1) that assumes she will be allowed in... but there will no chance of her working while she is in Canada and she will not qualify for medical coverage.

Oh, we know she can´t work. The offer is for when she is done with pr. I I´ll be back there in February and that is likely when we get married. I will there be any issues applying for out of country pr right after that, but or should we wait? She would likely come here as a visitor in the spring and hopefully wait out the rest of her application. The she would be staying with me and money isn´t really a problem so she doesn´t need to work.

get her across the border before sending in the application. That way she can honestly say she is visiting. The minute it sounds like she is waiting out her application they will send her back. No indication in her belongings that she is moving.

If you are married, it is still going to cause red flags for border officials. They are not daft.

She will still require a US address and may have to go back for an interview.

Do not be tempted to file inland - takes forever and there is added risk.

Makes sense, the only thing I wonder about there is that I know since shes from the US she doesn´t need to apply for a visa to visit and that once crossing che has 6 months to visit, after which she needs to apply to extend the implied visa she will have from crossing. I imagine applying to add another 6 months to her stay might raise interests. Would we mention that we´d applied for PR on the extension application?

Also, wouldn´t getting married after she gets here then applying for PR right after cause them to question the marriage?

coming back and forth is touchy at the best of times. Yes, it may raise interest but what choices do you have? she can go back to the US and wait it out. You can go down for a vist... it is a bit of a crap shoot.

CIC is used to the applications coming quick on the heels of a marriage. Bigger issue... having sufficient evidence that the marriage is a logical part of your relationship and that it is not being used to secure Canadian status. As an American there is less issue with this but you must prepare your application in the same way a lawyer prepares evidence for a court case. It is up to YOU to establish for CIC that your relationship is for love and than it is enduring. That means historical evidence of phone bills, plane tickets, photos that include family members etc.

In the legal system, you are innocent until proven otherwise, With CIC, they assume you are lying until you prove otherwise. Understand the difference?

Proving the marriage is genuine shouldn´t be much of an issue, I´ve got 5 years of airline receipts and I´m sure I can put together some chat logs and such. Though we´ve always used a voice chat system and rarely called so there isn´t much for logs there.

I know visiting is kind of risky in this case as coming back in you can´t really convince them she has a reason to leave once a PR application is open, so she probably wouldn´t be leaving. I just mean should we have to worry about extending her vist past the normal 6 months once we´ve applied? Assuming she intends to wait out the whole application.
