Subject: Help, what are my rights?
  Hi im an English ,Canadian resident i moved here in 09 and had a baby with my Canadian boyfriend of 6 years,now things have turned sour and abusive and i want out of this situation.I want to leave but my boyfriend has threatened me that he´ll take my son away from me if i try to leave.I cant leave the country because hes taken my sons passport away and hidden it! i know we have to go through legal channels over custody for our child (he already saw a lawyer)but he keeps telling me that i wouldnt be able to leave and go back home even if i did gain custody,is this true?im on low income and dont have any money after paying daycare and bills to go hire a good lawyer,i have no family here to help me and im too ashamed to tell my friends whats going on....please can someone help me gain a little hope, im desperate for a solution...i wish i could move out but i just cannot afford to, even with us both working we barely have enough left after paying all the bills for food,its a joke! i want to go home with my son and have a life again,pleas if anyone has any advise,help or suggestions it would be very much appreciated.

questions: is your residency legal? did he sponsor you?

a)IF you are legally a sponsored, landed resident: he is responsible for you for 3 years from landing regardless of whether you are living together or not.
b)common law relationships have the same status in court as married couples when it comes to custody etc.
c) if you feel that you and/or your child are in danger - get out! Go to a woman´s shelter where they will help you.

d) can´t determine if you could leave with the child - he would have to give permission, or the court would have to allow it. He is hiding that passport so you can´t take off with the child. I can understand that to a point - once you are out of the country, it legally gets very complicated.

IF your status in Canada is not legal, and he has not sponsored you... you have some immigration issues to contend with that may involve a deportation order. Your child would be factored in to that decision. However, it sounds like you WANT to go back to the UK. Obviously, you want to take the child with you, so... I would contact that shelter and see if there is some legal support they can point you to that might help you sort this out.

anonymous, those questions are not for you to ask.

in every case of divorce, a child gets caught in the middle. Hopefully, both adults will act in the best interest of the child. The majority of kids in these situations grow up just fine. What is he going to grow up to be? I am assuming that is your way of heaping more pain on this situation than needs to be.

Neither you nor he has Legal Custody of the child. If he was listed on the child´s birth certificate he can fight you for custody.

Get out of the relationship the best way for you personally but get out of it. The relationship no longer exists from your comments. If you have siblings and parents get them to cough up for the sake of their Grandchild.

It costs nothing to fight for Custody. I have a client fighting for custody now and it takes time. If your residing with the biological father custody will not make sense.
