Subject: PRRA
  i separated from my would have been sponsor (canadian born) in november.
2 weeks later, acting on a tip off (!!), CBSA picked me up and issued a removal order.
I got bail, as we have 2 children together (irish born, dual citizens), for the pending family law proceedings. - even at the hearing, the judge hinted who called!
I submittied a PRRA, but being from Ireland, i have very little chance of success.
My grounds were cruel and unusual treatment, by my & my children being separated for at least 1 year, my AA program is so sucessful in Canada, and my health improving so much with Canadian diet (i have Type 2 diabetes).
My question is:
When (probably), my PRRA is negative, how long will i have in Canada before i am given a date ot leave?, and what options are open to me between the decision, and leaving?
I presume before i leave i apply for PR under H & C, and hope they continue to process that, even when i am back in Ireland....

congratulations on your success with AA and the improvements in your health.

as you suspect, I don´t expect that is going to help you very much as you can likely replicated the treatment and success you are having back in Ireland and since your sponsor is no longer prepared to sponsor you - you only option is to leave Canada and to return on your own merits. You have been separated from your kids for how long?

Roy... is there a humanitarian case here?

she left 16th November.
When i get the date to leave, and i leave, can i apply for H & C from Ireland? How long would that take? Bearing in mind that my daughters are here? (5 & 6)

are my going to get grief getting back into candada if the PR is still in process? its a long time to be away from each other....

Well Sharon being Type 2 Diabetic for more than a decade got me no compassion.

The issue here is do the children have passports? The PRRA result is probably being delayed until all the kids and you have travel doc´s.

Any fight over custody??? Who are the children with? If you don´t want to be separated from the kids go to Family court and fight for Legal custody.

Go to www.cic.gc.ca and search for operational manuals and read Inland Processing IP5 section on Best Interest of the Child. CBSA/CIC have to be alive, alert and sensitive to the best interest of the child.

The children have Irish passports, but are dual citizens.

family court proceeding are starting feb 6th, its why i got bail.
she has the children, and we are fighting for joint custody. it is very rare that a judge grants no access at all in family court.
CBSA kept my passport when they picked me up.
worst case scenario, you think that a UK (no embassy in Ireland, just a consulate), would take approx 6months?
My lawyer here (legal aid), would have helped me fill it out before i leave, or do i submit it here BEFORE removal?

The kids are Canadian Citizens, if the parent can prove that the kids are better off staying in Canada since there is nothing for them back in Ireland, the court likely will issue the custody for the kids to stay in Canada.

Unless that you can prove that their safety is compromised and they will be better off with you, the custody will stay with the Canadian parent. There would be no removal order against the children. They are Canadians.

As for you. Your PRRA is not going to fly and you know it. An H&C application in process will not prevent your removal from Canada. You have to understand on what grounds an H&C is approved. What can be possibly so unusual in your situation that requires compassion from CIC so they will grant you a PR status?

One tip I would give you (I don´t do this to often) is to find a job and align it, so hopefully based on your education and experience (if applicable) you may return either on a work permit or under the PNP. There are a few steps you would have to take to overcome your inadmissibility though.

i know the PRRA has no chance, its just delaying the date - they are my children, i spent 8 days in maximum security detention so i can go to court for access.
They are much better in Canada, i know that, no point in arguing otherwise. I left a job paying 759e a week to come here for them. that was in the semi-conductor industry in a clean room, so nothing like that available here.
i was hoping that a H & C would succeed as most family law cases believe that both parents are important. i was curious how long the H&C takes. if i am granted anything, it will be added up, so hopefully summer holidays in ireland as soon as school ends.

I highly doubt that your wife or the court would allow you to take the kids to Ireland. What is to guarantee that you would return them. Far too much risk involved.

DocD has given you a good suggestion that has the best chance of success.

Your last post changes everything. In order for you to be able to ever come back to Canada, there are some extra steps you are going to have to take.

Overcoming your inadmissibility into Canada is going to take several years before you can even apply for it.
By the way, you are inadmissible in the US as well.

The best thing you can do is to comply with the court judgement if any in terms of custody and CBSA the day that is time for you leave Canada.

I received a letter from CBSA yesterday, and they scheduled me for an interview on Jan 23,2011, regarding PRRA under an removal order. However, I contacted CIC, and they said my sponsorship application is still in process, there is not any decision made yet.

I am wondering whether I would be removed after PRRA. If there was no chance for PRRA, how long they gonna ask me to leave Canada?

I don´t know what to do, since I´ve submit my sponsorship application for more than two years, and during the waiting time both my passport and my work permit expired.

Could someone please tell me what can I do?
