Subject: removal without identity documents...
  Also one aspect of my partner´s removal and the sponsor family´s refusal to give birth parent´s names is that we have been unable to submit an application to Burundi for a birth certificate, national identity card and passport.We have many applications to regain status underway and expect he would return even if forced to depart.CBSA obtained a travel document from the Burundian Embassy in Ottawa.Would they really fly him to Burundi and he would be left there after 16 years away from the country with no personal ties....to try and then obtain all those documents?How could I know the Burundian Government would issue a birth certificate in a timely fashion for when I win the right to have him come back to Canada?Can Canada really do this?Would they?I read Manual ENF 10 and it says an extreme case would be removal with the travel document and a piece of expired ID....he has nothing and there were no copies of ID docs he had upon arrival.We are very distressed.Anyone experienced this or have experience with a similar case?

Yes CBSA will try to obtail a travel document from his embassy. Once the document is obtained, he will be removed from Canada.

If CBSA is unable to properly identify him or the embassy is going to take a while to issue a travel document OR he is deemed as a fly risk, likely he will be put in detention until his deportation is finalized.

Once he is in his home country, the onus on obtaining the proper documentation for him to return to Canada is his. That would be an issue between you/him and his government. Nothing to do with the Canadian government.

in our june 10,2011 meeting with the CBSA officer at the GTEC location...we signed the laissez-faire document without retaining counsel...if he hadn´t signed I´m pretty sure they would have arrested him....but I specified with the officer that this LF application would garner us a birth certificate and she said yes but that it would not guarantee a passport...otherwise we would have continued to try and do the birth certificate application on our own...if we had known this was not the truth he would have refused to sign,been arrested and dealt with the matter through the detention review process...my question is what does the travel document signify?how did they verify he was a citizen?did they simply verify the fact he arrived in Canada legally?how do we understand that this document signifies the Burundian government recognizes his citizenship and if they do why did no other id doc get processed as we waited 7mnths to hear about a travel doc issued?he has a prra judicial review heard on january 12 and the dept. of justice was able to have cbsa agree to stay removal procedures until the judgement.our h&c is almost complete....no one ever told us that a spousal sponsorship would stay removal procedures...how come no one said?can we also put forward a refugee claim as he landed with pr status in 1995 at the age of 13yrs old. THANK YOU SO MUCH FOR YOUR RESPONSE!!!
