Subject: Canadian returning with USC wife
  Hi, I´m a natural Canadian citizen married to a USC for 3.5 years, living with my wife in the USA.

We have been fighting for my US adjustment to legal permanent resident since being married. I suffered a major injury before we married (5 years ago) and was unable to walk or work for three years while recovering. I also could not receive work authorization approval until 11 months ago. My wife supported and nurtured me through all of that and although I now have a work card and a job, I still have physical challenges.

We are getting frustrated and overwhelmed by the never ending process in immigration court here. Every time we see hope, another hurdle is placed in front of us and we again have our savings drained.

I have done some research to see how smoothly a return to Canada might be. It sounds to me like I would have to move back ahead of my wife, find work so I can support her (laws aside this would be the financially responsible thing to do anyway).

My big question is, could we expect any of the trials and tribulations we are currently going through, to get my wife to Canada and what kind of timeline would be reasonably expected?

If you apply via the outland route (recommended for Americans), the official processing time for spousal permanent resident applications is 11 months (this was the time required to complete 80% of applications). However many applications are completed significantly faster. My husband´s application, for example, was approved in four months.

We are looking at June 2013 before we even get to go back into court here, been 5 times so far. Won one appeal which took a year and a half so 11 months doesn´t seem insurmountable. Is there a way that my wife can visit for more than a couple weeks ? For job hunting etc. when we get closer to the move date. Do I have to be in Canada for the start of the process through to her landing? Ie: can we start the process next week and then I go ahead in 60-90 days or so to find work and housing?

The immigration process in Canada is not as easy as you may think.

You have to sponsor your wife first. I would highly recommend you to apply for her Permanent Residence status while you are in the US. Once approved then move to Canada. The process might take just over a year.

If you attempt to move to Canada with your wife before then, you risk that your wife might be refused of entry into Canada.

Sure, but don´t I have to be working in Canada in order to sponsor? So, realistically I would have to go back before she could land, yes?

Let me clarify what I´m not understanding. If we apply from here, do I have to be able to show proof of ability to sponsor her when we finally do move? How does one do that? I´m employed in the USA, and so is she, but those jobs would obviously be left behind inthe USA when we move! If it takes a year or more, how do I find a job in Canada and convince that employer to hold the position for a year? Can´t see that happening, so what am I missing here?

Money talks, BS walks.... It is cash-money my amigo; try to save up in US some cash and show that as proof you will be independent when you arrive, during the settlement period.
