Subject: Stay of removal
  Hi,
My Prra was refuse and I was given a removal date for January 30th, 2012. With the help of my lawyer we appealed the removal and the federal court gave us a stay of removal. A CBSA agent called me at home to inform me not to come to the airport and that they will communicate with me when the federal court decide on my case. Now this week I received a letter from CBSA requesting for me to come to there office for an interview scheduled for February 22nd, 2012. The letter also says that I´m required to be in possession of my passport, national identity card or any permit delivered by Canadian authorities. Also, that I may bring any other supporting document that I wish to be considered.
Here is my question, my lawyer is out of the country but her secretary advised me that no decision has been made on my case yet. So what is this interview about? Is it CBSA or the federal judge who makes the decision from here on? Is there any chance they may retain me there until a new removal date? What kind of supporting document can I add to my file?
I´m seriously worry about this and have no idea what to expect or do to better my chance of staying in Canada.

Your chances of staying in Canada are slim to none. Your PRRA was refused and you were granted a stay of removal by the federal court, hmmm.
Anyway,
Probably a decision has not been made at this point but you are required to report to the CBSA office.
Do it!

Unless that the officer believes that you are not going to be available or easy to find if/when the decision is made, he/she may keep you under custody.

If you fail to appear, then CBSA can issue a capture order against you and once you are caught, then CBSA will put you under custody.

Quite honestly, unless you have any new evidence that was not available at the time of your PRRA or any evidence that it was mis-read by the officer, your chances of staying are slim to none.

My best advice for you is to comply with the officer´s request and show up on time.

I will definitely go to the interview and yes I´m aware that my chances of staying are slim to none. But want to use all existing legal process available to my defense first and then what ever the final decision is I´ll comply to it. The main thing for me right now is to provide the correct documents that can prove my case.

Highly unlikely the Fed. Court has ruled on his stay as of yet. sure sounds as if CBSA is over stepping their authority and harassing Max.

Max is taking his case to court and is entitled to due process. There is no issue of identity, danger to the public and how could anyone assume he is unlikely to appear he has thrown himself at the mercy of the courts which are open to the public.

CBSA and Vic Toews are not above the Law.

Thank you Roy,

You illustrated my point very well. I moved to a new address my first year in Canada and the process to inform the different office of immigration plus taking my lease agreement for them to have a copy of it was so complex to me that I decided that I would not move anymore until this process is over with. I´m not a flight risk. This will be the 9th time I´m requested to come to the immigration office. I always complied. I check the Federal Court web site every day and I see no decision has been made yet.
Could you please tell me Roy? Does CBSA have anything to do with the decision? Isn´t it only the Judge who will decide of my faith?
Do you know why CBSA is asking me to bring with me any other supporting document that I wish to be considered?

The Justice department represents the Minister in Federal Court (NOT) CBSA.

The Federal Court Judge is the one that renders the decision.

I suggest ask your Legal Counsel regarding being called to CBSA again or again. Then I do note rarely does Legal Counsel attend at Mississauga GTEC due to the fact it takes too long and clients will not payn their high fees.

Find someone else who can speak on your behalf forcefully to CBSA.

hi there.I applied for the prra and it was rejected..when i went through the the reasons i found that there was some errors my the officer,which mention somethings that i didnt mention in my application,he must have been misunderstood but i have to go to an interview on tuesday the 13 of march to receive travel arrangements..what can i do about that mistake?can i inform them when i go there or include it in my appeal?

..GREETINGS TO YOU..PLEASE I HAVE A QUESION.I LIVE WITH MY COMMON LAW PARTNER FOR ALOMOST 5 YEARS.. NOW I HAVE INLAND SPONSORSHIP APPLICATION AND I WENT TO MY MEDICAL EXAM 3 MONTH AGO...AT THIS MOMENT CBSA IS TELLING ME THAT I HAVE DEPORTATION OTHER AGAINST ME..PEASE WHAT CAN I DO TO STOP THIS.
