Subject: Spouse Immigration with work permit
  My fiancee is a Canadian and i am an Indian working in a software company in Bangalore.I am planning to immigrate to Canada and work there after marriage.

Am i eligible to work after marriage or do i need to get a dependent visa and then arrive to Canada and apply for work permit. I went through the http://www.cic.gc.ca/english/work/apply-who.asp but did not get any info regarding my case.
Please assist.

No - you will not be eligible to work in Canada once you are married. Once you are married, your wife will have to sponsor you for permanent residency.

If you apply inland, you will be able to work once your application has first stage approval. The processing time for first stage approval is currently 12-13 months.

If you apply outland, you will be able to work once your application has been approed, your PR visa has been issued and you have landed in Canada as a permanent resident.

You do not qualify for a dependent visa if you are marrying a Canadian. Dependent visas are only for spouses of skilled foreign workers currently working in Canada.

Sorry i have to disagree with you. There should be some option to at-least work temporarily without PR.

The only question is on which visa category should i enter Canada?

If you want to work without PR, then you must do the following:

- find an employer in Canada who is willing to hire you
- that employer must then apply for a Labour Market Opinion
- if the Labour Market Opinion (LMO) is approved, you must then apply for a work permit
- if your work permit is approved, you will be issued a closed work permit (not an open work permit) that is tied to that specific employer

Note that in order to hire you, the employer will have to prove that they advertised the role and were unable to find a Canadian to hire or train for the position. Since the economy has slowed down in Canada, there are more people looking for work and fewer LMOs being approved than in previous years. This is especially true for IT roles. Many/most employers aren´t willing to hire foreign workers or go through the LMO process because of how much time it takes and because there is no guarantee the LMO will be approved.

As for how you should enter the country... If you don´t have PR status yet and you don´t have a work permit - then you would have to apply for a TRV (temporary resident visa) that will allow you to enter Canada as a tourist.

Alternative - your Canadian partner returns to Canada WITHOUT you, and applies to sponsor you. Takes 8-12 months.

Much faster than your Labour Market Opinion.

And you must still find an employer first. And that employer has to apply for an LMO. And if the LMO is approved only then can you apply for a work permit from your home country.

Dear Sir,
I have a job offer from edmonton Ab, with LMO confirmation. Now please tell me What type of Visa I write in from is it open work permit or skilled work permit . I also intend to bring my spouse with me not to work there but just stay with me. How do I apply for her. My employer agrees to provide every assistance in this regard.

My dad was nominated by sinp we are in jamaica now waiting to hear when to do our medical. I am engaged and I want to know what is the quickest way to take up my fiance so he can work. If we get married after I am a landed pr, will he automatically be able to work? Or will he still have to apply for his own work permit? He already has a temporary visa.

Hi folks,

I am about to get married to an Indian guy on an open work permit in Canada. His post graduate work permit will expire in second week of August 2013. He has got his PNP nomination from Ontario govt. and they say that they will issue a support letter for him to enable him to extend his work permit. This extended work permit will be an open work permit for 18 months from the date of issue. His PNP nomination will expire in last week of May 2013. We have two options:

1. We get court marriage done in April 2013 and then he would apply for PR for both of us together.
2. For now, he applies for his PR alone and then we get married in traditional way in November 2013 and then he would add my name to the application.

We prefer second option.

My questions are:

1. Will I be able to come to Canada on the basis of his extended work permit in both the cases or not?
2. If there is any issue with me not being able to come to Canada on open work permit immediately after marriage in November, what is possible solution for the same?
