Subject: general spouse sponsorship question
  Hi everyone,

I am a Canadian citizen and have lived in the UK for 10 years now. I am married to a UK citizen and we have 2 children who have dual status. My husband and I would like to move to Toronto. We are both well educated professionals with financial resources behind us to move. As his sponsor, will I need to be employed beforehand or will our financial records be enough as we are both very employable people? We both intend to secure jobs prior to our arrival but will my husband need a job offer before he submits his Permanent Resident application? Any help greatly appreciated!

No - you do not need to be employed beforehand.

No - your husband does not need to secure a job in advance.

However you must include proof in the application that you plan to return to Canada and establish yourselves here once his PR is approved.

Read section 39 and understand you need an Option "C" to sponsor your partner.

No Option C no sponsorship!

No evidence that you have a clear intention on returning before he is assessed, DENIED!

You need to come back right at the same time you submit your application with the kids.

He can come over to visit you the next week and seek out employment. HE is a UK citizen or resident so probably holds a EU passport.

I respectfully disagree with regards to the Option C. I have three friends (all separate spousal application) who were recently approved for sponsorship without an Option C. It´s absolutely doable. In all three cases, they had been living abroad for years and were now returning to Canada with their non-Canadian spouses. In their application packages, they included proof of income/proof of taxes paid from the country they had been living in and also provided solid proof they would be returning to Canada once their spouse´s PR was approved.

Debbie - Proof can be: job offer, proof of job search, rental agreement, real estate owned, proof of real estate search, school enrolment, bank accouts, etc.
