| Subject: Seeking asylum in Canada while pending USA asylum |

Hi,
I have applied for political asylum in USA and it´s been almost 2 years and didn´t have any decision. They did not even send it to the court. So now I am thinking about seeking asylum in Canada through going to the border. I have my own brother in Canada who is granted asylum and my name is in his application.
So can you please advise if it is OK to apply for Asylum in Canada while having a pending asylum in USA? Please advise. It´s very urgent and I really needs your advice.

there is no basis for asylum - you are living in a safe country. They won´t let you cross the border.

No I am seeking asylum in USA and it´s pending Now. yes, USA is safe country but I am not a citizen and approved fro asylum. I escaped from another country where I was subjugated and my countrymen are also subjugated and tortured.

it is called the safe 3rd country agreement. You are currently safe, regardless of your status, therefore you are not eligible to apply for asylum in Canada.

Under your asylum petition in the US you are not supposed to leave the US until a decision is made in your application. You should know that.
If you are under the impression that your petition is going to be rejected, you know that DHS will issue a warrant against you and next thing you know ICE will be knocking your door.
If that is what you are trying to avoid, I am sorry to tell you that you are not elegible to apply for asylum in Canada under the safe 3rd country agreement.
There are some exceptions to it but likely you are out of luck.
1- Safe 3rd country agreement
2- If the US is finding that there is no enough evidence to approve your request, what makes you think that CIC will?
Again, wait until you hear back about your asylum petition.
Wait until you hear back from the US Gov. about your petition.
