Hi,
I am a Indian Citizen and married to Canadian permanent resident last year. My spouse has applied for my permanent residency based on the family immigration and I have got the letter from Canadian immigration office in India (Delhi) to submit my passport and other related documents. This means that the application is in final stage.
At the same time, I have also got the very good offer from one of the big company in USA and they had applied for my H1B visa, and I have got the approval for that as well. I haven´t spoken about my PR file in Canada to them and they want me to start the job in USA as soon as possible. Even, I don´t want to loose this opportunity in very good company.
Now, I have the following questions.
1) Let´s say I have accepted the USA offer, then Can I transfer my Canada permanent resident file from Delhi (India) to USA somewhere? If yes, then what is the procedure? How much time it will take?
2) Once I submit my passport to Canada immigration office, how much time it will take for the visa processing?
3) Once I get the Canada permanent residency visa (or letter), Do I really need to go there? If yes, then minimum how many days I have to stay there to maintain my permanent residency? Is it possible if i go for only few days in Canada for the first time, and then come to USA for my job? Hows many days I have to stay in Canada when I go first time?
4) I really want to go USA on H1B visa, but at the same time don´t want to affect anything on my permanent residency application in Canada. If I cancel my Canada permanent residency file, Can I re-apply in the future? due to this cancellation, is there any affect in future application?
I am very confused right now and don´t know what is the best solution.

If you have enough time to send your passport to canadian consulate and get it back with PR visa stamped, you can immediately get the US work visa, fly to canada, do the landing and move to US to work... I don´t see anything illegal but not sure this info is ENTIRELY applicable in today´s conditions

They won´t transfer your file to the US. It will continue to be processed through the Delhi office. When they request your passport, you´ll have to somehow get it to Delhi.
Once you get the Canadian PR visa, you will have to cross into Canada and "land" to become a PR. You must then live in Canada two out of every three years to maintain your PR status.
Yes - if you cancel your application, you can reapply in the future. However if you do so, it will be a good idea to explain why you canceled the first application.
Hopefully your spouse is actually living in Canada since PRs must be living in Canada in order to sponsor a spouse.

it is true they will not change your app to reflect your presence in the US; however, once you get your PR visa stamped in the passport, you can land fro anywhere; after about a week or two in canada can depart to US; you have to stay TWO YEARS OUT OF EVERY 5 YEARS to maintain your Pr status.

Accept both - get your papers for Canada Pr say within apprx - 4 weeks ...then proceed to your US job - then as and when you can go to canada within 6 mnths for 2-3 days - get yr landing apply for sin card and come back to US...after a year or 2 of landing u can decide what u want to do all the best!

1.) You may accept the work in the USA as H1-B worker. The application in New Delhi will continue. You need to inform the New Delhi consular office of your new address. Do not transfer your file, it will start all over again in the new office.
2.)Processing time is posted on the Canadian CIC website. It is the same as if you are still in New Delhi. It has nothing to do with your physical location. Processing time has to do with the office work load.
3.)After you receive your landing papers (the necessary document for you to travel as immigrant to Canada), you must go to Canada before the expiration date. You leave Canada after you landed, not to exceed a maximum of 3 years out of 5.
4.) You can have both H1-B and Canadian PR. The only rule is not to exceed the 3 year limit after you have landed in Canada. Visit the www.cic.gc.ca website. Search Permanent residency.
I have both H1-B and Canada PR and I am staying in the USA.

Hi, You can very well accept US offer and work there. On getting your Canada Immigration Visa you have to land in Canada before your Visa expiry date. You just need to land there (you can even travel from USA on weekend). Apply for your SIN and PR card (you can even stay for only two days)and then go back to USA. Once you get your PR you have stay in Canada for 2 years out of every 5 years to maintain your PR status. Hope this helps you.
