Subject: Departure Order: HELP
  Hello,
- I am 27 year old right now. Me and my family immigrated to Canada on Entrepreneurs category in Oct 1997. ( i.e. total six including parents, I was in 7th grade at that time )

- My father didn´t complete the residency requirements and went back to Pakistan.

- On Jan 2008, 4 members of our family return to Canada on PR visa issued by Canadian consulate in Pakistan. And since then we ( 4 people i.e. brothers and sisters ) are living in Canada independently.

- On our PR renewal, immigration found out we haven´t completed our residency requirement. On Feb 2010 immigration gave removal orders to 4 of us.

- We appealed on ´Humanitarian and Compassionate ground´ and our appeal has been rejected.

- Now we are given departure orders from IAD on 22 March 2012. ( i.e. we have 30 days to leave Canada before departure order becomes deportation order)

- 2 of us ( single ) are still enrolled in University in Toronto. 1 is working full-time ( single ) and another ( married ) has a Canadian born baby girl ( only 6 months old ).

Though we can appeal to a Federal court. I am not sure whether it´s going to be helpful in anyway. Please advice what should we do on this kind of situation or What other alternatives do we have so that we could stay in Canada.

Sorry but what are you going to appeal?
You can only appeal that the law was improperly applied or the officer missed an important piece of information or point that is related to the decision making process and then the Federal Court didn´t included in their final decision.

It is not the case here. Clearly you didn´t meet the residency requirements thus you are required to leave Canada.

I am not sure if H&C was the best route, but your chances to stop your removal from Canada at this point are slim to none.

You may apply however for PR from outside of Canada on your own merits if you qualify.

You had your chance during the process to stop the removal process and stay but now that the departure orders have been issued, you are done.

@DocD - Yes I agree with you, but what next ? :S
@simple - I just told you what just happened to us. NO, I haven´t decided to go underground and I´ve been working as a Mechanical Designer in Toronto. We are thinking to go back to Pakistan before 21st of April.

Since I´ve done masters in mechanical engineering, therefore I am also considering to apply for Alberta Nominee Program.

Anymore suggestions ?

Nothing, that´s it. You go back then apply for PR from your home country and come back once the application is processed.
