Canada will refund money ?? I doubt, because Canada send checks by regular mail and almost lost in Canadian postal service before departed from Canada………….
What is the mercy for others paid thousands of dollars to immigration lawyers ?????

they say you will get a refund and you are free to apply under new rules. Isn´t that better than waiting another 5-10 years?

Nobody forced you to pay an immigration lawyer.

Take Canada to court... by all means. Good luck.

Subject: Regarding news release- Govt of Canada transforms economic immigration program.

Respected Sir,
With all the due respect I want to draw your kind attention toward the news release updated dated March 30, 2012 on official Canadian site www.cic.gc.ca with the heading “Govt of Canada transforms economic immigration program.”
It is stated in the new release that, “The Federal Skilled Worker Program backlog is a major roadblock to Canada’s ability to respond to rapidly changing labour market needs,” said Citizenship, Immigration and Multiculturalism Minister Jason Kenney. “Having to process applications that are as many as eight years out of date reduces our ability to focus on new applicants with skills and talents that our economy needs today.”
As announced in Economic Action Plan 2012, Citizenship and Immigration Canada is planning to refund fees and return stale applications from nearly all those applicants who applied under the dated criteria in existence before February 27, 2008.
CIC is transforming its suite of economic immigration programs to create a just-in-time system that recruits people with the right skills to meet Canada’s labour market needs, fast tracks their immigration, and gets them working in a period of months, not years. Eliminating the longstanding backlog of FSW applications will allow the Department to focus resources on facilitating the arrival of skilled immigrants who apply under the current eligibility criteria.
Under proposed legislation, CIC will close the files of FSW applicants who applied before February 27, 2008, and for whom an immigration officer has not made a decision based on selection criteria by March 29, 2012. This is expected to affect around 280,000 applicants, including their dependants. CIC will begin the process of returning the full amount of fees paid to the Department by these affected FSW applicants. For those who have passed the selection criteria stage – approximately 20,000 people – CIC will continue processing their applications until they are approved for entry into Canada or not.
Over the last decade, the number of FSW applications received has greatly exceeded the space available within the Immigration Levels Plan each year, resulting in long processing times and an increasing inventory. Under the 2008 Action Plan for Faster Immigration, CIC began to limit intake to priority occupations. The Department added caps to the number of new applications in 2010. As a result of these efforts, CIC has reduced the pre-2008 backlog by more than 50 percent, and the overall FSW inventory by over 25 percent. However, without further action, some FSW applicants might have to wait until 2017 for a decision.
“It’s unreasonable to keep applicants waiting for another five years,” said Minister Kenney. “It’s also a far cry from the nimble and responsive immigration system Canada needs to remain a destination of choice.”
I will like to draw your kind attention towards the anomalies in your statement with regards to the previous policy adopted by Canadian immigration services which I think will affect the career and future of large number of the people who had applied for immigration before year 2008.
I will like to discuss these anomalies point by point to present the case of 2, 80,000 people and their dependents that have been waiting for the last 10 years for a final decision on their applications.
1. All these application which were received by the Immigration Department before 2008 were based on the criteria set up the immigration and citizenship department and approved by the Govt of Canada. Every single person had applied according to the immigration policy of that time and it was mentioned in the confirmation letter issued to the applicants that it may take more than stipulated time. It is not mentioned anywhere in those letters that their application will be returned to them after a long period of waiting by giving excuse that if the immigration department will have large back log, then their application will be returned without any decision.
Sir, I find this attitude a bit cavalier. What you are purposing is that to end the back log, instead of giving priority to clearance of these files, these cases should be thrown out. In my entire life I have never seen a departmental policy which in pursuit of clearing the files throw out the files which are there for the last 10 year.
Secondly, my humble question to you that if your department was not able to process these files to a final conclusion due to lack of man power why they have accepted those application which now seems to be a great burden on the immigration department. I will also like to draw your kind attention to the fact that the above mentioned applicants have paid the required fees for the processing of their cases.
2. Other matter which I like to discuss with you is regarding the policies and new policies formed by the Department of immigration. As already mentioned above, the applicants pending with your department had in no way forced their files on you department. As per the policy of your Govt before 2008 they were eligible and eligibility criteria were set up by the Govt of that time as per the requirement of the labor market. My simple question is that if a Govt formulates a new policy, will it not honor its previous commitments? If a new policy depending on the changing world scenario is needed will the new application received after 2008 will be dealt in the same way.
It is a classic case of throwing the baby out with the bath water. In order to spick and span your departmental back log you are willing to play with the lives of millions of people.
3. Regarding the return of the full fee amount of the applicants, I want to draw your attention to the fact that CIC had already issued letters in 2008 to the applicants with regards to the return of full application fee.
It is mentioned in those letters, “If you are no longer interested in immigrating to Canada and you wish to withdraw your application, please confirm that you want to withdraw by sending a letter within 90 days to the Canadian High Commission in Delhi and we will return your full application fee.
If we do not hear from you, we will assume that your continued interest in immigrating to Canada, and your application and fees will be retained for processing. No further offer to return your fee will be sent. When we are ready to actively begin processing your application we will contact you to request updated information.” I will like to draw your attention to the fact that it is no where mentioned that the files will be returned without taking a decision. After four years of issuance of these letters the cases of the applicants are to be thrown out without taking any account the trouble and waiting they have gone through.
4. Another matter which hounds my mind is regarding the compensation and the interest which should be paid to the applicants if their files are to be returned without their assent. As you know every applicant had paid a sum of Canadian dollar 550 per adult and 150 dollars per child. If we take it is an average family ( with two adults and one kid) an applicant had paid 1250 Dollars to the immigration department for as processing fee for their application. Until now this money is lying idle with you department for the past 8 to 10 years. Now when you are considering sending back those files, is it not fair to pay the interest on that amount to the applicant. It should be also noted that Canadian dollar had appreciated during this time.
This was regarding the money an applicant had paid as per the policies of the Govt of that time. What about the compensation? These applicant had full filled every criteria set up by your Govt. Now when you do not want to fulfill your commitment, does is not calls for a compensation for every applicant who had waited for the last 8 to 10 years with a hope that in near future immigration department will process his file and suitable decision will be given.
In the end I request you to give your kind attention to these facts and proposal for the benefit of millions of people who are going to suffer because of this decision. I will also remind you that we live in a civilized world and these dictatorial decisions do not match with the current scenario. Please give these applicants a chance and listen to them instead of making one sided decision.

Hope that you will be able to understand the feeling of millions of people affected by this decision.

yes! we should protest if our requests are unheeded. We should take every legal action available for our rights. First of all we should start a group of the expectant applicants from all over the world. Secondly we should approach our country´s foreign affair ministries to protest against the dictatorial attitude of the Canadian immigration ministry.
lets also plan a sit over protest in front of our local canadian consulates.

i am open for any suggestions from you people. The open letter to Mr Kenney was sent on April 3, 2012 along with copies to members of house of commons mainly Mr. Wai Young, Alice Wong, Tim Uppal, Divinder Shory, Jasbir Sandhu, Parm Gill, Nina Grewal, Olivia Chow, Michael D Chong. Still waiting for their reply.

I guess there is another option. Retain your fees and deny your application- one at a time.

you are right, it is not nice and it does not seem fair. Processing all the applications is also not feasible unless Canada closes off all current applications until the backlog is gone. While that may sound preferable, there is one big thing to consider... what are you going to do when you get here? I am assuming you want to work in a job you were trained for.

2012 is NOT 2008 or 2004. This forum has been full of complaints about finding employment after landing. It is not getting any better.

Which is better... hard to say but Canada is in a no win situation either way.

Be grateful that this Minister is doing that. He just shows the true colours of canadian bureaucracy:
No accountability,
no reliability,
we do what we want because we are entitled and if you complain we will red-flag you.
I know that it may feel like something frustrating because you invested a lot of money. However, believe me.. In this country you will end up working 6 months of the year for the government in order to pay you high taxation and the other 6 months to survive the high cost of living and save to get a holiday to get you out of the depressing weather and isolating society. Maybe with that money you could have open a business in your home contry. I know every case is different and some countries in the world are really fucked up so Canada still may seem like a better option, but really it is not nearly as good as the propaganda makes you believe. The level of inefficiency is high. I ´ve gotten better medical service in Mexico and some other latinamerican countries than here. Here if you need a surgery they make you wait up to a year to get it.
Anyways If I were you I would be thanking the Minister because he is representing the real compassion of this country. Believe me! many bad things happen in here like police not being accountable for their crimes. Government behaving like a police state, etc. It just does not go published in the international news .

Dear Sharon
If they are going to deny my application and retain my fees after due process even then i will think that there was shortcoming on my side which led to this denial. In this new policy they are going to chuck out my file without even going through it after a wait of 8 years!!!!!! i don´t blame the institution, i think what they are doing is for the benefit of economy. But what about justice. Do you think this is justifiable to through out the case without giving a proper go through it. Let the cases be rejected on merit or medical ground. Nobody challenges that. It is the dictatorial attitude which hurts you. What about the money? they have used Can$ 350,00,00,00 of these gullible applicants for past 8 years and now they want to short change them by throwing their case out because they don´t have the resources to deal with them!
As far as finding employment is concerned, nobody is going to burn his bridge to return home if he does not find a suitable employment. I will like to bring to your kind attention it is clearly written in the immigration journals that govt will not provide any kind of social security and it is necessary to carry suitable amount for your daily needs. Even the amount required by a person depends on the size of family immigrating to Canada.
We can go on discussing this matter without any end in the sight.My simple question to you is, "whether this move is justifiable?"
i presume that you are a Canadian citizen. If you are than you can never understand the feelings of these applicants who wanted to have any opportunity to dream big for themselves. Now everything they have dreamed for is gone.
Do you think if in future your courts have a large backlog of pending litigation, then the justice department will form a policy to throw out all the litigation without a proper trial on the plea that they don´t want to have a large back log?
Dear Sir, Universal truth is that the govt are all the same everywhere. They don´t give a damn about anybody.
