Subject: Confused about landed immigrant visa...
  Hello, I have gone over everything and I´m so confused about our situation!

I am canadian citizen. My wife is Australian citizen. We have a house in australia we have been renting for the last couple years. I have been in Australia on ETA visa and when my 3 months are up I usually go to canada then return. I am presently in australia with my wife (we got married in canada last september) We have planned to move to canada may 6th. I was hoping to get all her landed immigrant applications and my sponsor applications finished before we leave. but it is taking long becuase I´m so confused with everything! Here are my questions:

what is the difference if we rush and get all these papers done before we leave for canada or just get to canada, she will be on a visitor visa, and then lodge the applications. Will it make any difference? She will want to be travelling for a few weeks here and there when we arrive in canada, to the usa. Will this be okay?

Or do we need to get the papers done here in australia and send them off and then travell to canada? So confused!!!!

You should apply from outside of Canada first. The process will take roughly over a year for the embassy to process the application.

The best way to do it is from outside of Canada.

If you choose to bring your wife as a visitor and apply from within Canada, she will be facing two risks.

1- She may be refused of entry upon arrival since she doesn´t appear to be a genuine visitor.

2-If she is allowed to enter, there is no right to appeal the decision of the officer regarding in-land applications. That means that if the officer refuses her application for permanent residence, she will be required to leave Canada.

IF she enters Canada as a visitor, I would highly recommend you not to leave Canada until her application for PR is finalized. Otherwise, she risks being refused of entry back into Canada which will screw her entire application up.

One word of caution though, in-land applications take longer to process than outland applications and she will not be allowed to work in Canada until she is approved in principle. It might take several months.

Best option (highly recommended) is to apply from outside of Canada in Sidney and wait until her application is processed and approved.

thankyou for your response. When you mention to apply form outside of canada and wait till her application is proccesed and approved, does that mean not to go to canada while waiting? what if we applied here in australia, then went to canada in may on the visitor. then find out in a few months its passed and then she can dip down to america and back into canda to start the visa?

and also you mention it would take a year to process, why have I read places it only take around 3 months???

Hi

I sponsored my family to come to canada. I want to know about my brother who was below 22 when I sponsored him as my parents dependent child. He is now 25. My question is if he has to maintained full time student until their application as accepted and they are landing to Canada.
