If your currently in a genuine common law relationship while still legally married their is nothing to prevent you from submitting a Spousal Sponsorship application and being approved.

Roy, help me understand how this works.

Common law is pretty easy to establish especially when we allow for same sex relationships. You would still need to declare your status as married or separated.

Are you telling me CIC is actually going to process a sponsorship application in this instance?

Yes especially for ones that can not get a divorce or an annulment. Regardless it is the current relationship that counts and you put down common law.

Come on Sharon think about the kids feelings. Parents move on with their lives even though they do not file for divorce because of the kids.

Others file for divorce and the fight over property heats up and keeps the other from getting the final decree but they have been living with another for three years. Like I said it is a genuine relationship so why not sponsor your partner?
