  Hi...

Good day...


I am new on this forum, i hope you can give me advices on this matter:

I have a friend who entered in Canada as a skilled professional over 3 years ago. He is single but had a child and now he is planning to apply for SINP. During that time he was not ready to bring his child as he and his partner are not in good terms and he knows that the mother will not allow his child to be brought to canada, so he did not include his son on his application before he enter in canada. As of the moment he want to settle in Canada with his son. But he is currently undecided if he will include his son in his current application, as he is thinking that his application for his residency will be declined if the visa officer finds out the case of his undeclared child. My question is: would it be a ground for deportation or the rejection of his application (SINP).

I assume he entered as a Temporary Foreign Worker TFW and never listed his child.

It matters as to whether or not the child is medically examined. 3 years is a long time and there is no details as to the age of the child. The forms have changed drastically. Now there is an additional family information form. Look to your copies of the forms you completed when he applied.

List the child have the child medically examined and maybe just maybe in the future the biological mother will have a change of heart.

It is never good to lie.

Simple terms:

Whether he was going to bring the child or not, he was supposed to declare the child PERIOD. Anything shorter than that is called misrepresentation and yes, his work permit can be cancelled and he can be excluded from Canada.
And yes, it affects his SINP.

How hard is to tell the truth from the very begining?

Hi Maria,

I have the same experienced with your friend. I entered in Canada in 2005 under the Live in Caregiver Program. i did´t declared my son, I´m a single mom at that time but as soon as i change an employer here in Canada i started declaring my son. I even went back home to get married to the father of my son and declared them as my dependents. I applied for Permanent Residence last 2007 include them as my dependents, got my Open work permit on 2008 and they sent me a letter asking me to explain why i didn´t declared my son as my dependent when i applied for my LCP program. I hired a lawyer to help me explain my situation. They transfered my file to a local CIC last 2009. And up to now my papers is still in process. They didn´t refused me and they asked for a second medical of me and my dependents. On e-cas my file was already Decision Made. And requested the passport of my dependents. My family´s medical will expired three months from now. Still waiting for their final decision. I´m praying that they will grant me my Permanent Residence because they will not go this far if they will just refuse me. Your friend has an option of going back home and just re-apply or get a lawyer and just wait for their decision. But it will be a long long wait,he needs a lot of patienceand lots of prayer. No. the best thing to do is to declare the child.
look for someone to ask important questions about this matter.

i would like to know if possible that the immigration cannot refuse our papers, my husband did not declare his child before entering canada,and now they called the immigration to ask what to do, the immigration told them to explain everything in writing and attach to our application.. is it possible that our application maybe approved? pls. help me. thank you.

i am a permanent residence now in Canada because of my father he was the principal applicant i was able to come to Canada me and my 3 sisters and my mother all of our family, my big problem is that during application i didn´t declared my son in a situation that we are not married yet,and because i was adviced by my parents i will not declared my son and wait for us to get married or become citizen in Canada, it is the biggest mistake of my life following their advice, i was so dependent to my parents that all decisions being made are came from them, our culture in Philippines is to respect their decisions most of the time,my parents was so confident that they are not breaking the law, and now i am so depressed, any suggestions what to do,i really love to sponsor my Girlfriend and child to come here to Canada cause in Canada i see very great opportunity/ Future for my kids for me and my family. now i have 2 kids, 1st child was before coming to Canada, and the second child is after i landed Canada, before coming to Canada my girlfriend was pregnant. pls help
