Subject: married but not married
  I came to Canada as a married person but three months after i submitted my permanent residence application, my wife refused to join me for reason best known to her. I immediately sent a spouse withdrawal application to the concerned office which was accepted complete with refunds. Now if I want to marry someone else from back home, what documents do I need? Am I still considered married by the immigration office?

You can´t marry someone new until you divorce your first wife. If you marry before divorcing, your second marriage won´t be valid.

yes, you will be considered as a fraud. first, you have to get divorce from your wife. after that you can marriage.

So far you have received very poor advice but from whom?????

Your posting is unusual to say the least. When you came to Canada as a Permanent Resident you were married and your wife failed to join you makes more logical sense. The other way you worded your post one could interpret you came here and then submitted an application some how and included your wife in the application. Either way as long as you received no points based on her being on your original application there is not much to worry about.

If you are a PR residing in Canada or a Canadian Citizen you must first get a divorce where you normally reside (if Canada) that should take four months from inside Canada, if the divorce would be an uncontested divorce. You may also need to obtain a divorce in your former country to be allowed to legally re-marry.

Then you need to really prove your new marriage aka Spousal Sponsorship.

Hi would it be considered legal in canada after remarring in the dominican republic? This was granted by the judge, normally they have a 10 month waiting period for the woman after she is divorced. It is an old law they have in case the woman was pregnant from her previous spouse. i am 50 yrs old so hence my waiver. I am in the process of sponsoring my dominican spouse. We have been together 20 yrs.
