  To All

Focus on common sense and providing supporting documentation to support your application. Do not try to re-try your refugee claim because the IRB and NOT CIC review what is or isn´t a Convention Refugee.

CIC Officers are the ones that assess humanitarian and compassionate factors.

Always remember that if the average Canadian believes you should be shown compassion so will the vast majority of Immigration Officers.

If CIC finally asks for birth certificates or expired passports there is no reason for any negative concern. CIC does not remove CBSA does.

Good day Mr.Roy and fellow members,
please i have some technical questions to ask you about H&C and PRRA application. I applied for H&C in September of 2010 and PRRA in December of 2010.My PRRA is almost one year and five months with no decision up till now. Here is my question,i just got a new girl friend just ave me a baby few days ago. I was going to update my application, but just wanted her to give birth before sending them any updating. So how do I incorporate my new born baby birth certificate or any form of identification that she´s is mine. I just want you to give me any illustration on how to draft it up.Please any positive ideas or opinion should be fine.

Just got a girlfriend and she got pregnant and gave birth in a few days????

Well the statement of Live Birth would be a great help as evidence or the actual birth certificate. (copies)

My question to you is why are you waiting for the birth of your child? Why have you not formalized your relationship with a marriage?

Now depending on which country you are from it could take a long time to get you a passport to remove you. There must be something valid regarding your H&C find out if they have joined them at Vancouver b\BRO or better transferred your H&C to a local office.

Thanks for your quick response Mr.Roy. Here is the point, the marriage stuff is not going to happen. The family are really having so many issues with me now. I´m black and she´s white.She stopped working and went on welfare for no reason.Now i told her i´ll be involved in my daughters life regardless of what her family is saying. I don´t do drugs or even drink any alcohol lolz. Just because I´m black a serious issue to them right now. I had to pressurized them before they could put my last name for the baby.I don´t want to have any form of criminal or violence record in my life.i have a great future ahead of me. I´m going to school now part-time as a practical nursing in Toronto. I work full time.I also volunteer for both red cross and world vision organization. I gave CIC so many documents to prove case. I´m from west Africa, Nigeria to be precise. So the issue of forming up a relationship, i don´t think that is going to work mr.roy.

I got a letter from Vancouver BRO office that they received my files in January 15,2011. In july 10th,2011, i got another letter that my files has been transferred to Montreal BRO office for further decision. The Montreal BRO office have my files(PRRA and H&C).

Adding your daughter to the application with a letter or even a copy of the original birth certificate it doesn´t really add anything of value to your H&C application.

The only thing that can add something to it, it would be "the best interest of the child" and why you have to be around her.

Keep in mind that the mom and kid are Canadian citizens and mom may have to testify WHY you MUST/SHOULD stay in Canada based on the best interest of the child. Otherwise, the whole father-daughter/EX-GIRLFRIEND thing is not going to fly.

These are the two angles:(only one is right)

* Your point of view:
You are going to say, that you need to stay in Canada to be a father to your daughter.

**The Government:
You are using your daughter as an excuse to stay since you are running out of options. It is up to you to prove them otherwise.

Keep in mind one thing though, that an H&C application in process DOES NOT PREVENT your deportation. You can still be removed even if a decision hasn´t been made in your application.

Thanks DocD, I knew before that adding her to my application isn´t going to make any significant periodic changes to my application. I know i just have to add this information. I guess reporting this information isn´t going to hurt my application.Thanks again DocD for the response. I´ll do just as you´ve said and i´ll have a better discussion with my legal representative.Sometimes it is better to get a widen scope experience thoughts from various people.

What crap are you writing about DocD?

The only thing is Best Interest of the Child. Get Real.

He is from Nigeria and it could take two years to get a passport for him to remove him if his is expired or does not exist.

What about legal custody neither of them currently has that. Oh I get it he is a man so the child belongs to the mother "baloni"

Why can´t he take his daughter with him?

Look at Nigeria´s educational system, write about it. Is he deserving, who knows not enough detail here.

Let us look at the country of Albania and their educational system. Most schools do not have flush toilets, many no running water and several with no roofs. Teachers are not really paid and demand bribes for tutoring or passing the child.

There is always hope when one deals with common sense.

Let´s begin with "What is common sense?"
I will give you my definition.

What are the chances that a person FROM Nigeria who has a foot already in an airplane and who can be removed from Canada ANYTIME is going to get the custody of a Canadian citizen child that if removed if going to face hardship, when there is a Canadian family already here? REALLY, REALLY?

He said it. Her family doesn´t like him for being black. What I am reading is, SHE HAS A FAMILY!

Chances of him getting a custody of the Canadian child at this point in time are SLIM TO NONE!

The fact that can take two years to get his passport, doesn´t prevent CBSA to put him in custody if necessary until his passport arrives, that statement alone shoots ANY possibility of obtaining a custody of a child, besides if his ID has been confirmed, CBSA can remove him with a temporary travel document, even without his passport, you should know better than that.

If we based the amount of deportations of Nigerian Nationals even with their current educational system, army and economics, NOBODY from Nigeria would be ever deported. But the reality is that Nigerians get deported. Most of them don´t get to stay.

Just take a look at the H&C application that get approved PERIOD.

That is my definition of common sense Mr. Consultant.

If you want to make the so called "Common sense" a fairy tail, fill your boots, knock your self out. But "Common Sense" without supporting documentation means NOTHING.

The best interest of the child of having his father around is a heavy factor no doubt about it, I don´t vouch or question that his child needs him. I am just giving you a preview though of how this man is going to be viewed during this process.

It ain´t pretty but it is the truth.

DocD She has family in Canada but she is on WELFARE!

Taking into account the best interest of the Child he won´t be going anywhere if he is before the courts in a child custody dispute because the biological mother is a &*(&*%&&

He is Nigerian and does he have a valid travel document, NO well he has a minimum of three years to fight for custody.

More CRAP DocD because the Embassy is taking to long to issue a Passport CBSA has the authority to detain someone!

People can only be detained if they are a Danger to the Public, Unlikely to Appear for Removal or Identity other than being a terrorist.

CBSA can not remove him without a passport because they must change planes in another country and the airline will not risk getting stuck with bringing the person back at their cost.

Did you forget about this guy or do you want to be detained yourself in Africa?

Are you saying Black men are not real Dad´s? That all Biological Mothers are real good Mom´s?

From the limited information regarding what Stephen posted I see him as a man who has class and credibility who is not going to rush out and marry anyone just to stay in this country. I see him as a Dad who cares about his child and is very hurt by the actions of the biological mother and her extended family.

You and I don´t have enough information to really look at the big picture. The fact of the matter is that I am not telling you what I think should be the case. I am just painting REALITY whether you like or not as it is.
