I applied for PR in 2004,no progress. I believe the govt now intends to return all applications before 2008. Can I apply as student to study here in Canada?
Will it have any bearing that for no fault of mine my file is being returned?

Sure - you can apply. As part of the application process, you will have to demonstrate that you have strong ties to your home country and no plans to remain in Canada long term.
