Subject: P R Divorce and custudy |

I have aquired my PR card and have lived in canada for years will possibly divorcing my husband of 17 years
we have a child together and am wondering if the courts will make me stay in canada because that is what he wants. I am a U.S. citizen and have no family here. He is a good father but without my familys help he is not going to be able to pay spoucal and child support to a proper degree.
will I be in for a battle?
and no have not talked to a lawyer yet, i live in a small town so wanted some input first

(in reply to: P R Divorce and custudy) you will not have a battle to divorce or to remain in Canada but you may have a battle when it comes to collecting child support or spousal support.
By the sounds of things, you are assuming you will be returning to the US with your child. Do not assume that. 1) the court has to grant you custody and 2)your husband has to agree for the child to leave the country.
Talk to a lawyer. If at all possible, try to settle this through mediation. Better for your child and a lot less money.

he would not be able to pay me anything no matter wher i moved to and yet he will not willingly allow me to leave the country
i thought maybe someone else had this same situation??
also i know i would get full custody unless the judge was deranged! but if i HAVE to stay in canada then i would file for joint, then when he defaults on all payments see if i could leave then
