Subject: revoke pr
  Hi everyone,
i hope i can find help here. and i am going to try to make a long story short.
in july 2010 i met my canadian wife in mexico while she was on vacation visiting my country.
we fell in love and we spent everyday together and we decided to be together.
she went back back to canada came back to mexico in november 2010 and we got married on christmas day.
she applied for my pr and we got approved and i landed in vancouver bc in december 2011.
a few weeks later i received my pr card.
i got my first job at the end of feburary.
the arguments started in april when she found out i sent the half of my first pay from work to my country to help my jobless brother. she said i used her to come to canada to help my poor family. but thats not the case i didnt use her but i always helped my family.
i couldnt handle the arguments and i left, we got separated in april 2012. and now she is threathening to revoke my pr. can she do it? i need to know in advance so i can prepare myself. i want to build my life here with or without her. but if shes going to cancel my residency then i would rather leave canada myself than get detained and sent back. i dont know how it works so please if you can advice me tell me what to do and what she can do i would appreciate it.

Only a Member of the Immigration Division can issue a Exclusion order (removal Order) for misrepresentation where no H&C factors can be considered.

Then that order can be appealed to the Immigration Appeal Division where they can consider H&C factors.

Proving what went on behind closed doors is very difficult. it comes down to quality of evidence and not what he said-she said.

Well, it depends.

Separating from your spouse is not a crime in this country, so if your "genuine" relationship didn´t work, you cannot be penalized for it.

HOWEVER! If she can prove that you used her to gain a PR status in Canada, then CIC will have your ass for lunch and yes, your status can be revoked on the grounds of misrepresentation and eventually you will be removed from Canada.

Well, sending half of your pay cheque to Mexico and expecting the poor woman to pay your way in a city as expensive as Vancouver is, does not seem fair to me. Not to insult you buddy but I have dated quite a few latino woman and as soon as the cash is not available, they leave. Help your family with what you can afford. Otherwise you and her will be living in poverty in Vancouver. You are not going to get rich in Canada and it is o.k to help family members but do not expect others to pay your way in here. I just find strage that you can not negotiate this situation. Canadians tend to be very understanding. I have seen relationships that once the immigrant gets the PR , they come up with all kind of excuses to dump the partner once they land. I am not saying that this is your case, but it just seems very interesting that you can not reach an agreement with her.

well, I don`t think you need to be separated just for this reason..you can avoid from this situation easily if you believe that you didn`t use her to gain PR..

I would suggest you to explain her as you explained us..If it doesn`t work..good luck fighting with CIC if she try to revoke you PR..

I do understand that in some other cultures people tend to help each other more. However, you do not live in Mexico now and must get used to the canadian way. You also are getting yout family accostumed to do nothing for themselves if you keep paying their. I have seen many cases like this, where the family in the poor country exploits the family member living in a richer country as they think that money grows from trees in wealthy contries. Perhaps you have not experienced yet the extent of how expensive is living in Vancouver and also if you lose your job here and have no friends willing to give you a hand, you are alone. Here, you must take responsability for yourself as nobody else will. So help brother with what you can and talk to the girl. If you are using this excuse to dump the lady.. Good luck!
