Subject: Landed status in question and taxes |

My husband and I have an unusual situation. My husband, who is an US citizen got his landed status for Canada in April of 2002 which was sponsored by me, however he continue to commute to the US for work. We legally separated in 2007 so he returned to live in the USA. As we are border town residence it enable him to commute back and forth regularly for approximately four years, staying with us ( his daughter and I) overnight a minimum of 3 days per week as his work was only one hour away in the US. He did not file taxes during this period as we considered him a non resident due to us legally being separated and him having his own home in the US. Recently he began working in Canada and staying with us 100 percent of the time. As we are not sure of his Canadian Status we maintain his US residency but would like to give it up. My question is; Did he maintain his Canadian residency during this period? Is he working here legally and what are our tax ramifications now?
