Subject: URGENT!,mispresentation in docs regarding marriage
  Hello Roy,

After reading many discussion on this site, I still didn´t find my answer :(
I am a international student just applied for my work permit. I got married last year(june2011) with my boyfriend under some pressure where i was not ready.i never took this marriage as an actual marriage coz we wanted to do the ritual marriage in india. we got our Ontaro marriage certificate done but things never went good between us from the day of our marriage, we tried to find out the ways to get divorce or annul this marriage but not finding any proper solution. we still put the single status in all our documents(income tax and work related)even we are married. nobody knows that we are married in actual coz we don´t even live together anymore, but recently I filled my CIC open work permit documents and put my status as single again and now i am worried if they will deport me or it will effect on my PR or work permit in marriage. or is there any possible way to annul this marriage since that was a stupid mistake and i was not mentally prepared. Please provide me any possible solution coz i am really going through a huge tension and its disturbing me mentally n affecting my personal and professional life both.

Now let us look at the basic factors in your post.


Let us assume in May of 2011 (or earlier) either you proposed marriage or you said "YES I will marry you".

Then you went and applied for a marriage license, presented identification listed who your parents are and which municipality you intend to marry in and when.

Then you had to have a say in where & when you planned to wed and someone had to book the chapel and pay for same.

Then you picked a pastor/person who is authorized to marry you in the province you reside in and pay him/her to perform the ceremony.

On the day of your wedding you had to bring two witnesses so they had to be agreed upon.

During the ceremony you were asked if you would take your partner in matrimony and you said "I Will".

After the wedding ceremony you probably had a small party/reception with friends/family to celebrate your wedding.

Later that night you probably consummated your marriage vows with your boyfriend by having intercourse.

Where you not ready for the sex or was that another silly mistake?

I like to advocate on behalf of victims when it comes to the Immigration Act and the Regulations but was this all a silly mistake????????

You had opportunity after opportunity to say NO but you kept saying YES.

*****I´m sorry I can not see you as a victim.****

You´re a student in Canada and you speak English.

Now you tell everyone on an Immigration application you lied! You state this lie + your marriage is causing you huge tension and disturbing you mentally.

You got married in June of 2011 one year ago and you post here on how to get a divorce looking for a bleeding heart, - grow up!

Preet,

Misrepresentation is a crime under the immigration law. The fact that you were disturbed, sad, etc, IT DOESN´T MATTER, nobody at the CIC office will actually care.

That is your problem and your problem ONLY, you were supposed to declare your marital status and you didn´t!

If you get charged and found guilty of misrepresentation, your status will be revoked and you will be removed from Canada. Plain and simple.

But I will be waiting in the wings advocating on her behalf so proving a violation can sometimes be difficult for CBSA.

ok, i understand what you say, so is there any solution to fix the status on my work permit, what can i do now and let them know or fill in my application again or some solution? and later on i figure out divorce n stuff, my first intention is to correct my immigration papers.

the other thing is we had no celebration or function, the time between getting license and marriage was too short, we had no friends as witness, we manage to get the pastor´s children as witnesses but yes i said " i will " but i wasn´t ready n we didn´t consummated our marriage because of my unwillingness and anxiety of doing wrong and his intention of getting dependent visa on behalf of me ,it turned out such a fight n never solved till today. our marriage certificate is another issue which we could not figure out. i just have only one name on my passport n all previous documents as only "harpreet" and don´t have my last name, and at the time marriage our paster asked for family name or if i want to use my boyfriends last name but i said i want as it is but she has put my family name as kanwar on it and my boyfriend name was only "dilraj singh" on passport and they used his family name and put it as dilraj singh sandhu,, now our names are big issues too coz they dont match with our passport and documents so the time is just flying and we are not getting enough time and fix appointments to fix all this with busy working lifes and other stuff.

hope you can put me in right direction to get out of this all mess.

Oh well.. this all sounds very complicated... Don´t you wish you had annulled the marriage within weeks or months after you guys had confrontations and disagreements? Wish I could help you but any attempt now to alter the docs (since you were clearly married at the time you filled the paperwork), will only alert the CIC ppl and if they haven´t realized or know at this time, will make it known and hasten the proceedings in the direction you do not want them to go. Instead, find out and rapidly conclude the divorce matters. In that way, if things do not go smooth, you will be legally prepared for future. If they do go smooth (with CIC remaining in the dark about your marriage episode), this matter will remain on your conscience... and you will be single too. Please refrain from using his or your full real names on web while seeking advice so your personal info does not get exposed. good luck. Sit tight and clean up the marriage mess.
