Subject: Need some advice about getting my wife to canada.
  Back in september of last year my girlfriend at the time came up to canada as a visitor and during that time we got married ( we had planned the wedding ahead of time ) and attempted to get her a visa to stay with me there. We ended up filing for a visitors extension because we were still waiting on paperwork to be able to send away for her permanent resident visa, and we were granted the extention for up to march of next year. I had lost my job back in april of this year and haven´t been able to find anything else since then, so we waited on submitting our visa application simply because I wanted to be working to show them I could support her. So after months of bad luck and no job her parents offered to bring us to the USA and take care of us for a while until she found a job and I was able to get residency here. We took them up on the offer and they bought us one way plane tickets. At the border we were stopped and brought inside to document my stay because I had no ties to Canada ( We left with the intention on trying to get me a visa from inside the country, we sold our car, all of our possessions and moved out of our apartment ), and we lied to the border officials stating we were only coming to visit a sick relative, because they were going to deny me entry. Now it turns out that was not a good move on our part because US immigration will see that we had lied about the sick relative and likely deny my visa. We have been married since September of last year and only want to live together and start a family.. With this information of me being likely denied we are trying to assess our options and figure out what we can do, so we can still live together and get this visa. We are willing to reverse our situation and move back to Canada, but now we are worried she will be denied re-entry because we still have not sent away for her Visa, and we would be coming back over the border with the specific intent on applying for that and staying there.

Can anyone out there offer some input, or advice for this situation? It´s so frustrating the governments make it so damn hard for 2 people from different countries to be together, that they make it almost necessary to lie to get across, then give you trouble for doing so.

We both hate the thought of having to separate for a year or more to become legal, as we have already been living together since september.

Any help at all would be greatly appreciated.. We are just at a complete loss of what our options are now, we feel trapped.

I understand I maybe should not go into so much detail about our intentions and such, but I need an honest opinion of the situation and I really don´t want to escalate this to a point where we both are ineligible to enter each others countries. We both know we have made a couple of bad choices regarding the way we have crossed the border, but all we want is to be on the right track for our future so we can live together and start our family as soon as we can. If that means having to separate for a year I guess that´s better than never getting to see each other again, but obviously if there would be a way to make this work while living together we would much prefer to do that.

I don´t understand why you didn´t apply to sponsor your wife as soon as you got married. She would have PR by now. No minimum income is required and it wouldn´t have mattered that you didn´t have a job. You´ve made things unnecessarily complicated for yourselves (this isn´t the government´s doing - it´s your own).

At this point your best bet is probably to apply to sponsor your wife outland and submit the application. Once the application is submitted, then your wife can try to re-enter Canada. It would be best if both of you entered together. Bring proof that you have applied to sponsor your wife (and have paid all of the fees) - this will show that you are working on making her status official in Canada. Your wife should assure border officials that she knows she´s only being admitted into Canada as a visitor and will follow all of the visitor rules.

I understand we have made it complicated, however we had made our decisions based off what people had told us and what we had researched. We believed we could do all the paperwork from inside both countries, and thats why we have just went ahead with it. Looking back we both already agree we should have done this a long time ago, but we also didn´t have all the information we needed to submit the application at that time. We also married right after she came into the country, and were told we needed to wait as well so it didn´t appear she was just marrying me for status. Would you happen to know if I will need to be in Ontario for any interview process? We are more than willing to submit from outland and doing it that way, but as of right now we have buried ourselves in debt with these decisions ( we know it´s our own fault ). We just need to know if there´s going to be a lot of back and forth because we can´t afford to spend tons on plane tickets to keep going back across the country, as I live in Ontario and she is from Washington state (West coast). Trust me, we are kicking ourselves in the butt for this bigtime.. but we honestly believed we would be able to do this legally from here. It just turns out the US is way more fickle for entry and I guess we should have expected that, but what´s done is done and we just want to correct things as fast as we can and try to move on with our lives. We really don´t want to separate if we can at all help it. I still have 5.5 months left here in the US legally as a visitor, do you have to apply to become a sponsor first before submitting the out of country application for her PR? If so do you know what the processing times are like? Again, like you said we have made it unnecessarily complicated and we know it´s our own fault, and we are really just trying to fix our mistakes. I appreciate you taking the time to reply and giving us some direction. Thank you!

You really need to spend some time reading through all of the forms to understand them and make sure you put together an accurate application. If you´re uncomfortable doing that - considering hiring a reputable lawyer or consultant.

No - you don´t apply to become a sponsor first. You must submit the entire application package together. If an interview is required, it will be for your wife only and will be held in the US.

Thank you for the information, it is much appreciated. I was under the impression I had to submit the sponsor application first, and if accepted to be a sponsor then I would fill out her application. One more quick question if you don´t mind answering it, would she have to travel back to her home state if an interview is required for her? or would there be a way to appeal it to a closer location? New york state or any state close to Ontario would be alright as I could likely just arrange a ride for her instead of having to pay airfare. Now if they process my application of sponsorship and they decide i´m not qualified for whatever reason, does that forfeit my wifes application entirely? and would we be back to square one? Thank you, and my apologies for all the questions.

No - she doesn´t travel back to her state if an interview is required. There are only a handful of visa offices in the US. She selects one of these as her preferred interview location when she fills out the forms. (I would once again very strongly encourage you to read through all of the forms and the instruction guide so that you understand the process. All of this information is there.)

If you are not accepted as a sponsor, her file will eventually be denied. You must be accepted as a sponsor if she is to be approved.

Alright thank you, and you said there´s no minimum income requirement for that, and I believe at this point that would have been the only thing I would worry about. I will definitely be reading the applications thoroughly, as after all we have been through we just want it done correctly. Thank you again for taking the time to provide this information and insight to us, we are very grateful.

No minimum income. However you cannot be bankrupt and you cannot be on welfare (social assistance).

I am not bankrupt, and I have been on social assistance in the past, but it has almost been a year since I last recieved anything from them, and I have paid back the overpayment I owed them, in full.
