Subject: Sponsoring
  Hi There,

I have a question regarding spouse/children sponsoring please.

I’m a Canadian Citizen .. I immigrated to Canada back in 2007 alone .. When I first applied to immigrate I was single but got married one year before I moved to Canada and did not apply for my wife as she was not willing to move to Canada due to her education/family needs.

I currently have two kids and I’m also living overseas after I’ve became a Citizen.

My question is, Can I still apply for sponsoring my wife and children or I’m not eligible to do that?

Thanks a lot in Advance.

Are you saying that you immigrated in 2007 (i.e. landed in Canada in 2007) as a single person when you were actually married - and failed to add your wife on your application?

If so - then you can never sponsor her. You also committed misrepresentation (you lied about your status at landing) which is a crime. You´re lucky CIC hasn´t figured this out since it could cause problems for your own status in Canada.

Solution? That is called misrepresentation. Do you realize that you obtained your Permenent Residence and citizenship based on a lie!

CIC can actually revoke your citizenship. You are not elegible to sponsor your wife EVER - PERIOD.

You should´ve thought about it before lying.

Wether or not your wife was moving to Canada, you were required to declare if you were married. That is the bottom line.

It doesn´t matter that you mentioned her on your citizenship application. The fact that you married her before becoming a PR but failed to add her to your application means that you can NEVER sponsor her. There are no exceptions.

The only option available is for her to qualify to immigrate on her own through an immigration program such as the Federal Skilled Worker program.

There is always solutions to every issue and some may be better than others but a Crime lol.

The key issue here is that your wife was not "examined" and something about her could have caused an error in the administration of the Act. Look up IRPR regulation 117 (9) (d)

Since your wife keeps visiting here there may be a better than 70% chance of winning based on a Humanitarian and Compassionate application taking into consideration the Best Interest of the Children.

That is if you got Canadian Citizenship for your children.

I venture to guess that the child has been with Mom and no citizenship has been obtained.

I would almost bet on in. Why don´t people read the rules? It would make life so much easier.

Nadeer,
Don´t let DocD and a few others here scare you. You may have not been clear on the application rules, and you need to find out more from CIC itself, not from this forum. As Roy says, a crime?... LOL.

Here you´ll find people who spend half their waking hours finding ways to criticize immigrants on their ignorance (in their way of thinking). It makes them feel important.

Call or go to CIC and discuss your situation with them. You´ll get a fairer reading and more accurate understanding from them.
