Subject: Spousal sponsorship working in Canada before PR
  Can anybody please shed some light on this question and answer from an immigration consultant´s site:
Can a Sponsored person work or study in Canada if their application is being processed in Canada?
While waiting for their Canada Immigration Visas, Sponsored persons are allowed to work or study in Canada only after the Sponsorship Application has been approved in principle by Citizenship and Immigration Canada. They will then be granted an Open Work Permit or a Study Permit.

~ What does this ´in principal´ approval refer to? Is it possible for a spouse to come to Canada and work prior to the final processing of his Permanent Visa application?

Another question:
If a sponsorship is started outside Canada and then the spouse moves to Canada after 6 months (entering on his multi-entry visa) what is the situation re: work and regarding how long he can legally stay in Canada? Are there compassionate grounds where he could stay until the PR is fully processed? And continue to work?

Come on people use some common sense.

Let us say that the applicant (John) is a healthy male who has overstayed his visitor status and is currently illegal in Canada.

John goes to home depot and bumps into Mary a single mother of two. They start a relationship which grows slowly but is a genuine relationship and Joe moves in with. Mary decides to sponsor Joe and the question is since Joe has been in Canada for three years now should he admit that he is working illegally or should he lie about how he has been supporting himself?

Tell the truth because if Joe lies the Immigration Officer will think that he is a jerk for living off the avails of a single mother. That all he is doing is using her to get status.

In principal only applies to applications filed from within Canada. Once the application has approval in principal (which takes around 9-10 months after the application is submitted), the applicant can apply for an open work permit.

If the person applied from outside of Canada and is now in Canada, in principal does not apply to them. If they wish to study before obtaining PR, they will have to apply for a study permit (they will have to pay foreign student fees). If they wish to work, they will have to find an employer who can obtain an approved LMO - and then apply for a work permit. As for staying in Canada as a visitor while the application is being process, the applicant is responsible for keeping their status valid by requesting extensions to their stay.

We all want the best of both worlds.

Waking up with our partner next to us and enough money to have those little extras.

The CVV Canadian Visitor Visa does not grant him/her entry into Canada. It eliminates the airline responsibility regarding removal costs if not granted entry at the Port of Entry POE.

Now you seem to be focusing on the negative instead of the positive. Look again at the processing times and clearly understand those "estimates" are based on 80% completion.

Not those that submiut a quality Spousal application.

Thank you for you help. I will soon apply to sponsor my spouse. We have two facts which I hope will not be held against us as we have a genuine marriage. I am 13 years older than him and we´ve known each other a short time.

Our time living together of one month we are perfectly matched. We want to do similar things at similar pace. We do not feel or even look like a mismatch (as he has aged prematurely :) )

We are making plans everyday regarding him working. A professional in his own country he is planning to start here, serving behind a store counter for 6 months if that is the first available opportunity - to get accustomed to Canada and earn grocery money til he finds his way to better work or self-employment.

So we both hope he could come back on his temporary visa about 6 months after he applies for PR (as an outside of Canada applicant), and finish up the waiting time on the decision while living here in Canada with me.

Does that sound practical, or problematic?

What is an ´open work permit´? Does he have to wait for PR DECISION level to be completed before there is any legal way to apply for temporary right to work?

~ Yes, we do all like to have our cake and eat it too. :)
And as the Immigration information is convoluted and circumstances all so different, we can only try to see what our best possible outcome might be. :) Thanks in advance for all comments and help.

If he applies for PR using the outside of Canada route - he will not qualify for an open work permit. If he wants to work before he becomes a PR - he will have to find an employer who is willing to offer him a job and also obtain an approved labour market opinion.

I want to sponsor my spouse to immigrate to Canada. He is currently on a working holiday visa here living with me. Can we apply for spousal sponsorship from outside canada as he technically is on a holiday, or do we have to apply from within Canada because he is physically living within Canada at the moment??
