On Friday, little Emily and Tony Jiang learned there is a Santa Claus. Their parents were accepted under Humanitarian and Compassionate grounds to remain in Canada permanently.

Winning an H&C application requires the applicant to prove they have an Unusual, Undeserved, or Disproportionate hardship, which is exceptional. The Jiang family own their own home, have their own restaurant, and employ Canadian’s. We had evidence that foreign children and above quota, children are not allowed to attend state funded schools in China. We had some evidence that the parents would have to pay a fine for having a second child who is Canadian but no clear evidence of the amount of fine.

Recently we obtained an official Chinese Provincial government document that clearly outlined what the minimum fine that MUST be levied for having an above quota child. It also outlines what fine MUST be levied for having a child out of wedlock as well.

These clients had great H&C factors and CBSA had emergency travel documents for the parent but no Visa’s for the kids. Delaying their removal until CIC could asses our H&C submissions from February to December required some innovative legal wiggling. I would like to say common sense rules but just maybe Santa Claus had something to do with their approval.

What is your problem with the word (ALL).

All persons are eligible to apply for landing from within Canada with Humanitarian and Compassionate factors regardless of citizenship.

All persons are eligible to apply to spend six months on the Space Station as well regardless of citizenship.

SG - Are you saying this family because they are Chinese are not deserving of compassion? Well over 20,000 took the time to go to their restaurant and sign a petition to keep them in Canada.
