Subject: Overstay? Passport Stamp.
  Hi,

I need to stay on in Canada for a couple of months extra and I am under the impression that my visitor visa is valid for only 6 months. If this is so, then I am due to leave Canada in 2 weeks. ( I am from the UK)

My questions are:

How can I extend my stay legally.

Also, the stamp in my passport that was given to me by Canadian Border officer`s does not have a leaving date on it, all other times when I have been to Canada there has been a date written on the stamp for expiry. Does the 6 month rule still apply?

I would rather do things legal and properly. I have only just found I need to stay on, so I figure I cannot apply to extend my stay the normal way as I am out of the 30 day limit.

If your passport wasn´t stamped with a date then you were given a six month stay. The only legal way to apply for an extension is the following:

http://www.cic.gc.ca/english/visit/extend-stay.asp

You could also try exiting Canada via a land border (i.e. going for a very short trip to the US). When you re-enter Canada, they may give you another six month stay. However it´s also possible they could refuse you entry into Canada - so this is a bit of a risky move.

Thank you for the link and info.

It says I have to apply 30 days prior to my visa expiry. My visa expires in 2 weeks. Maybe going to the US for a long weekend is an option. I have a totally clean record, and no reasons for anyone to stop me returning to Canada in the normal scheme of things, but I suppose like many other things it`s down to the person on the day.

The advice that Anonymous gave you is actually pretty bad.

What you have to do, is to leave Canada before your visitor status expires.

The fact that you failed to extend your status when you were supposed to is entirely your fault and now you are trying to circumvent the system.
An officer at the US port of entry knows it and when you try to come the CBSA officer will know it too.

Here are the two scenarios:
1- If you over stay, but the time you leave Canada you are an illegal alien. If you get caught it cause problems next time you attempt to re-enter Canada.

2- If you go the US and follow Anonymous´ advice.. well.... do you really think that the Canadian officers at the port of entry are that dumb? Everything in your situation points out that you are not a genuine visitor. That is not what visitors normally do unless you have a really good reason, I wouldn´t count of being able to re-enter Canada.

I am not trying to circumvent the system, I am trying to seek advice so NOT to get into any trouble.

As it looks, I will fly out, and return in a few weeks. Its just a costly exercise, and I would have rather paid to stay rather than travel all the way home again. The situation I find myself in has only just arisen, and as such I had no time to apply.

Richard there is no regulation that you have to apply to extend your status one month in advance. When one applies they have implied status as a visitor until they are approved or refused.

If CIC could comply with their own objective of the Immigration Act (prompt processing) then it would make sense to apply one month in advance.

CIC is currently taking 118 days for paper applications and 88 days for online applications.

WHAT IS THE PURPOSE OF APPLYING ONE MONTH IN ADVANCE?

You should of planned your temporary stay better, but......

Apply and stay then depart.

So, I should just go ahead and do my online application to extend my stay?

I had every intention of (and all my plans were in place) to go back to UK right after the New Year, But my mother has taken ill, and I want to stay a little longer, she is 70 and a Canadian Citizen. I have my own business in UK so have every intention of returning, I am just fortunate enough to be able to leave it to my employees to run.
