Subject: Sponsoring my future wife and her child
  Dear Sir/Madame,

I met my girlfriend in Peru in December 2011. We are planning to get married by the middle of May 2013. She has a daughter of 13 years, she also has a full custody of her daughter. Her daughter has her father’s letter of permission to exit Peru, and to immigrate to Canada.

If I get married in Peru and come back to Canada, the wait time for Canadian visa is too long, almost 18 months. I would like to sponsor my girlfriend and her daughter from within Canada. I will try to get them a tourist visa, they would come to Toronto, and stay here with me. I work as a lighting engineer and I make sufficient funds to support the 3 of us.

I know that the process takes 20 months when applying for PR within Canada. It is a long time, but at least we would be together. My question is, can her daughter go to elementary school while waiting for her permanent residence?
What kind of a status will they get after I marry my girlfriend in Canada?
Will they be able to get any medical insurance, will they be covered by OHIP?

I can understand why you want to be with them sooner than later but you´re going about it the wrong way!

Why do you think that you will be able to get a woman and a child into Canada on a visitor visa to circumvent the Immigration Act and the Regulations because what you consider to be excessive processing times. The Visa Post will see right through your request your going to screw things up BIG Time.

We currently have an In-Canada Spousal application for a client who overstayed in process since December 7th 2011. The applicants Visa Post takes three months yet they wanted to be together and now they are really struggling to pay the bills because she is not working which puts a strain on their relationship.

Go back and read the processing times that caused you to post what you did. It says "TO COMPLETE 80% OF THE APPLICATIONS" The times are based on how long it took to process 80 percent of all cases between January 1, 2012 and December 31, 2012.

That includes cases that are prepared poorly and are returned because they have to ask for additional documents. Also those cases that require an interview to be held at another Consulate etc.

Today again I replied to an e-mail requesting that we only charge a nominal fee to review the forms and not disclose that we charged a fee for advice against the regulations. IRPR Regulation 10 states if a fee was charged the person advising information has to be disclosed.

It is better to pay for assistance now to ensure that they are here faster then if you did the application yourself. If they´re rejected then you will have to pay three times what most Counsels charge to assist with a Spousal Sponsorship Appeal because your Lady got refused.

I agree with Roy. The chances are slim to none that CIC will approve a visit visa for your wife and her child.

Your reply is very informative, thank you very much.

As I mentioned before I am financially stable. I want to bring them here on a tourist visa and marry here in order to avoid wait time.

To fill you in on our status, I sent a letter of invitation to my girlfriend the summer of 2012 and she got a visa in duration of 6 months. I claimed that we were friends and nothing but friends, because if I told the truth I know that Canadian embassy in Peru would not approve her visa. She came to Toronto at the end of July and returned to Peru in September of 2012. This is the second time that she gets approved for a Canadian tourist visa.

This time, I would not send the letter of invitation to her nor her daughter because as you say it will seem suspicious to CIC.

My girlfriend is planning to apply for a tourist visa, for her and her daughter without my help. If she gets it, she would come here, and we would marry here. If she cannot get it, I would go to Peru, marry there, come back and start the application process…

Whatever happens, one way or another, I would pay for an immigration lawyer to help me with the application. I want to do it right, and I do not want to make any mistakes.

If she gets the visa and we marry here, if we apply from within Canada, what would the approximate wait time be for her PR?

About six months total from outside of Canada through Lima. Now be careful who you retain and understand the bigger the firm the less likely you will receive any personal attention from the boss.

Ask for references and confirm them. It is all the little things that any firm does to increase ones chances in a spousal application. Make sure you can view the actual forms on-line before submission to ensure everything is correct.

Thanks again.

In December of 2012 I paid a consultation fee of $300 and explained my case to Mr. Mandel Green of Green & Spiegel. He assured me that the best way to go about it is through his law firm, but he was asking more than $10 000 for his services.

I still have time, I will search for the best legal advice I can get for a reasonable $ value. I would more than appreciate it if you could suggest a few immigration law firms that might be able to help me out.

Roy is an immigration consultant himself. He just gave you an advice FOR FREE on what is the best way to go.

In a nutshell you basically have two options:

1- Move down to Peru if you want and sponsor your wife. As a Canadian citizen, you don´t have to be in Canada during the process and then you can move with your family back to Canada once the process is completed.

OR....

2- You can move to Canada yourself, sponsor your wife and once the process is completed then she can move to Canada. During the process, you may go down to Peru for a visit.

Trying to bring your wife for in-land application in a tourist visa simply is not going happen.

First, CIC officers normally, avoid to process in-land applications, trust me...it is not their coup of tea.

Second, there is no right to appeal of your application is refused.

Third, she does not appear to be a genuine visitor, visitors are supposed to leave at the end of their VISIT, what makes you think she looks and sounds like a visitor?

Apply from abroad.

Up to you, but these are your options.

DocD I believe is a CBSA Officer! He gave you good advice which was the same as mine.

How old is the kid? Hopefully you have tons of photos of you playing with the kid. Major important!

Twenty Five Years ago when I was the Ministers Counsel Mendel was basically retired when I found his client described then detained her and had her on the plane the very next day. Next time you see Mendel ask him about it!

He still is a member of the LSUC but would never handle your case regardless of what you retain the firm for their services.

dear sir

i got married afte my medical has done, but i didnot submitted my passport, i asked the extension for submission of passport from cic. now after marriage i have submitted my wife´s educational documents and marriage proof to the cic. now how long it will take for my wifes medical papers to come.
