Subject: common-law sponsorship
My boyfriend is from the UK and he wants to immigrate to Canada. I was told by my lawyer that we have to live together for one year before I can sponsor him. How can we do that when he is only allowed to stay here 6 months with his passport. In this year before I can apply for sponsorship, can he work in Canada?

Hello,

I believe you actually have several options. Your partner is from a visa exempt country. He can apply for an open work permit and see how that goes. Working holiday vmight be another option as well.

With regards to your laywer, you need a new one. No ofence. If there is some cause for you not to be married you can apply under conjugal in family class. If I am correct the year can be a tally of time together making it a year or more in total.

If he leaves for work purposes but you have bills showing you live together(rent, phone ect..) then that is your proof.

Personally, I think it is best to get married unless there is some reason you can´t.

There is another useful site google canadian visa forum.

Good luck!

Your Lawyer was right and gave you solid advice. Since your not married a girlfriend can not Sponsor her Boyfriend.

For any foreigner to work in Canada the main route is for an employer who is having serious difficulty finding staff is to advertise and prove they can´t find enough employees. Then they can enter into a contract with foreigners who have the skills to assist their Canadian company. The next thing the Canadian company would have to do is apply for permission to hire a foreigner through HRSDC called a Labour Market Opinion. Once an LMO is obtained tell the foreigner to apply for a work permit.

Now coming here on a working holiday BUMAC visa and moving in together for a year than submitting a Common Law Spousal Sponsorship as Sara suggests could cause serious problems.

On the Spousal Questionnaire when it says first contact, how your relationship developed etc. you´re heading for a potential misrepresentation allegation by certain CIC Officers. Someone may see your application for your BUMAC Holiday Visa as nothing more than a lie.

Conjugal - LOL

Liz if anyone applies under conjugal they have to show a reason why they can´t marry. The couple have to be in a committed relationship and have plenty of assets together to prove same. Your in a boyfriend girlfriend relationship and a long distance one at that.

There seems to be no permanent commitment here possibly it is time to move on.

VISA EXEMPT COUNTRY (in reply to: common-law sponsorship)
Ok, I have 3 degrees and I still can´t figure out all this stuff. Someone mentioned a visa exempt country (Scotland). What does that mean? Could my bf come here and work? How long could he stay? If we have to live together a year before I can sponsor him, how can we do that when a passport only allows you 6 months in a country?

Thanks for you all your help. There is so much to learn in all this :)

I beg of you, ignore 99% of what Roy is saying.

Go to google and search Canadian visa forum

you will find loads of help there

visa exempt means he does not need a visa in order to come to Canada

you have options... other than following the advice of an immigration consultant. perhaps educated, perhaps having the ability to boast won cases, but guaranteed to be looking out for his own wallet...
