Subject: QUESTIONS #11-12 ON FORM 5540
  Hi all,

I am just curious if these questions are only for naturalized and pr or do I answer them as well as a Canadian by birth? Also; I was in a common law relationship that ended four years ago but it says on the document checklist that they want a "declaration of severance of common law relationship". Where and how do I get one?

Thank you

@ Bruce

Many people will tell you to DIY do it yourself but after reading these questions do you really think you should be doing this yourself?

sort of condescending don´t you think? anyways who gets a declaration to say that their common law relationship is over? and where from? Shouldn´t a copy of a lease or a letter from a bank stating a dissolvement of a joint account be proof? If someone can help and not be nasty that would be great.

Thanks

Bruce you asked how many questions?

Well I am superior just based on the questions you asked so that is not condescending.

When you fill in the forms you will not be able to click on naturalized because you have Canadian citizenship since birth yet you ask the question about being naturalized.

Certain countries require a "declaration of common law union" in Canada we don´t even have a legal standing of separated.

I am not as dumb as you might think I am Roy; I guess I didn´t ask the question properly. I printed out the application and was filling it out by hand so I couldn´t "click". Sorry I should have said so:( It just seems that all four questions #9-12; are for those that are not Canadians by birth, however I feel like I have to put the proper answer as I have heard nothing but horror stories if the applications are not filled out perfect. For instance my soon to be wife was living with me until she had to go back to Japan- but she is still on the lease. As for the common law declaration; I thought it sounded a bit weird because as you said there isn´t an actual legal standing of separation. My former common law and I were together 12years and she was only separated. I appreciate your feedback and hope I am not wasting your time.

thanks again Bruce

When you begin filling in the forms the questions that do not relate to you come up shaded in grey. Therefore you can not answer those questions because they no longer relate to you.

By the time they look at your application the amount of time apart will go against both of you. Get legally married instead of trying to prove common-law. Find out if Japan allows proxy marriages that should save you plane fees.

Thanks--we are getting married on July 13th here (she arrives on June 27th) but then we go to Japan together Aug 8th and I have to come back on the 26th alone. We want to file the app. before we go as her criminal record check and medical check expire in three months:-( That is why I am so frazzled. Thanks again Roy

Are you aware that all the Visa Officers are currently on strike!

I sure hope she is admitted as a visitor.
