Subject: sponsoring a spouse
  hi all, i have a question about something that is holding me back from sending my application to sponsor my spouse. So in the application form: Application to Sponsor, Sponsorship Agreement and Undertaking [IMM 1344].
Question 1

Check one box to indicate how you wish to proceed if you do not meet the sponsorship requirements.

If you check the box to withdraw your sponsorship application then
the sponsorship application will not be processed. All fees will be refunded, except for the $75 sponsorship fee.
If you check the box to proceed with the application for permanent residence then
the sponsorship application will be refused. None of the fees will be refunded.
***** so my question is first of all can i leave this blank or do i have to answer it? and if i check box one does it mean automatically that my application will be refused? or is this just about the refund of fees "in case" i am not eligible? both boxes seem to mean that my application will be refused if i check one of them....can you please help clarify? thank you!

Hi there,

What they´re asking is if you DO NOT meet the requirements to sponsor your spouse, what do you want to do with his/ her part of the application package (permanent residence)? If you check the first box, then the entire application will be withdrawn, and you will get the majority of the fees you paid back. You will also get your personal documents back.

If you check the second box, your spouse´s application will still be processed, but without the benefit of your spousal info. It would be as if your spouse submitted an application for permanent residence on his/ her own.

Remember, these conditions ONLY apply if you are deemed ineligible to sponsor your spouse.

Based on my own experience (and lawyer advise) I would suggest checking the box to proceed with the application for permanent residence regardless of the outcome of your part of the application.

If (God forbid) you are deemed ineligible and decide to withdraw your application then, you can still contact the embassy/ CIC office and get the fees (and your personal documents) back. As long as they haven´t begun processing your spouse´s application, they will do this.
