Subject: Ex husbands PR application, my concerns...
  Hi all, I may have previously posted about this, but it has gone on for so long, that I cant find original post. I also thought it was all done and dusted.

My ex husband moved to BC in 2008, we have 3 children. He has applied for his PR status, and has applied for the children to have the status as well. He has said there is no choice in this, as they are his dependents and legally must be included in the application.

Over the last couple of years, there has been form filling, and me driving them hundreds of miles and sitting in traffic with the children going to medicals etc.... then last year, he emails my daughter and says his PR has gone through and that theirs has too. I thought that would be it.

last week, I had an email from him, saying that he needed copies of their passports by the 9th August so that a visa could be placed on them.

They do not have passports, so I am now rushing around trying to get them done.

I would really like to know why they have to be on his application as they do not want to visit him, and I am in the process of making their wishes legal in the event that I can no longer take care of them myself, that they do not go to him if at all possible.

He also says that work is really thin on the ground out there, but surely he should be in receipt of a minimum salary in order to have obtained the residency?

The childrens medicals expire at the end of August, and if it hasn´t actually gone through, then will they need another? Can I refuse? What happens if I do refuse?

I have never seen any official paperwork asking for any of this information, other than their medical forms, its all just asked for by him, with a paragraph saying how its nothing to worry about.

I just feel that this should have all been done by him as this is for his benefit, but I seem to be doing all the hard work. A small bit in his defence is that he does for everything that concerns his application, but it is still a nuisance, and I cant find any one who knows where I stand legally?

Will I eventually be asked to send off their original passports? That does not sit well with me, and every bone in my body is screaming out that something is not right here.

I don´t even have an address as to where he is living...everything goes through his brothers address, but apparently he has not lived there for a while.

Anyone have any ideas?

Everything your ex has asked you for is required and normal. Yes - the medicals are needed and yes - the passports are needed. If you refuse - then sure, you will be punishing your ex and will create problems for his application. However you will also be punishing your children and limited their future opportunities. Do you really want to do that?

It is very true that CIC (Canadian immigration) demands that children be included in the application (and medically examined) regardless of where those children are living and with whom. It is frankly in your childrens´ best interest that you participate fully. What if one of your kids wants to pursue higher education (college / university) in Canada? If they are included in their father´s application, it´s likely they can get PR status in Canada (as long as they´re not too old) and study as domestic students (domestic student = much, much, much lower fees). Same goes for having the option to work or live in Canada in the future. Think of this whole process as giving something to your kids (i.e. giving them options) rather than taking something away from your ex.

You can refuse to cooperate and force the children to be excluded from his application. If this happens, they will never be able to get PR status in Canada through their father. Many people would give their right arm to have the opportunity to have residency or citizenship of another country (I myself would LOVE to have EU citizenship in addition to Canadian). So think carefully before you cut this opportunity off for your children.
