My Morning Rant
The applicants claimed that they were seeking H&C consideration based on China´s Family Planning Policy in China. They have three children two which are Canadian. The CIC Officer gave detailed reasons for a refusal of their Humanitarian and Compassionate application based on that no supporting documentation was submitted to support what the parents H&C application were to consider.
The Immigration Counsel the parents had retained submitted evidence in an attempt to convince the CIC Officer that the family faced religious persecution. The parents had already lost their refugee claim and CIC Officers do not determine if a person is a convention refugee.
When you lose an H&C application you can appeal to the Federal Court if the negative decision is wrong in Law. When no H&C supporting evidence is submitted spending thousands to claim that a CIC Officer negative decision is wrong is clearly a waste of time and money.
Compassion has to be common sense.
I decided to submit a second H&C with plenty of supporting documentation based on China´s Family Planning Policy. I blamed the previous Counsel and never once implied that the previous CIC Officers negative decision was in error.
We won today!
Happy that two Canadian children will be able to attend school funded by the government of Canada to a hard working, well established family.
