Subject: What next?
  Hi,
I just recently received news that my refugee claim was rejected. My lawyer did not really tell me what happens next, as she does not deal with such cases. She only deals with refugee claims. I really don´t know what to do, or what happens next.

What my lawyer told me was that I am an old applicant, and therefore, the next best logical step for me would be to apply for an appeal from the Federal court. If I don´t apply for the appeal, then what happens next?

Some background information.
Before applying for refugee status, I had been in Canada for 8yrs, on a study visa, then on a post graduate work permit. I am in quebec, and had applied for the quebec selection, under the working category which did not go through, due to lack of language tests that I did not submit. I filed for refugee protection out of genuine fear for my life, and I am just wondering what to do next.

I am also currently in a relationship with someone that I love dearly, but we don´t want to do anything that will jeopardize our being together in the long run. It feels right now like I have already screwed that up, with my refugee claim, and I really don´t know what to do next.

Unfortunately your lawyer has no idea on how these things work. Appealing to the Federal Court is a waste of money and time. You can´t really appeal the decision, all you can appeal is that the process used to refuse your application didn´t follow the procedures as per the manual. Which is a shot in the dark. So don´t even bother.

Why on earth did you apply as a refugee? That is beyond me. You had all the tools available to apply for PR status within Canada.

What´s next? You will be removed from Canada. You will have to apply for PR from outside of Canada, apply for an authorization to return to Canada and once all the process is approved (if approved) then you can come back.

All is not lost!

I can only agree with DocD slightly but on certain points he is right.

Getting one decision maker (Fed Court Judge)to overrule another decision maker (IRB Member) is not easy unless the IRB Member failed to allow certain evidence in at your hearing.

Any Federal Court application will buy you another safe three months and may not be a benefit.

You appear to want to do all yourself or retain the cheapest person available.

You are in a relationship but have never said "Will You Marry Me" so now any Spousal Sponsorship whether In-Canada or abroad will have to be a real quality application because it will look like yourè using her.

There are many tiny ways to delay ones removal but the best chance of any success is a Quality Spousal Sponsorship application.

Thanks Doc and Roy for the advice.
I don´t want to do it all by myself or the cheapest way possible. That´s what got me in the mess I am currently in. So I am seeking the help that I can get and afford, and just trying to understand the process better, as opposed to making another errenous decision.

I also do understand that at this point, a spousal sponsorship will look suspicious and receive severe scrutiny. Thanks for letting me know the truth about the appeal process. It has been a real eye opener.

A few last questions. How does the removal work? Is it better to leave of my own accord or wait for the removal? How long till I get a removal order? If do decide to leave on my own before a removal order how would that work. Lastly, if we do decide to go for a spousal sponsorship, would it be best to do it from here or from my my home of origin?

I really do appreciate your help. Is there a way that I could donate to this site, so that people like me with limited options can continue to get quality advice ?

Hey Sharon you do not have to much time,you have just 15 or 30 -days to apply for the next move , go speak with a lawyer 50$-100 $ for a consult and get all the answers , if you are Montreal go to Noel San Pier very good one 514-844-6464 , you have a lot of option to stay ,
Federal court (you will not win but you will gain time)
PRRA another two years waiting gain time
H&C same shit different application gain time ,
Sponsor in land ..Do You - Yes I do ..
Long story short you need a fuckin lawyer and a good one
