Subject: CBSA - UNREASONABLE SEARCH AND SEIZURE

As a Canadian I am outraged at the recent 21 arrests by CBSA in Toronto.

Can you just imagine when stopped for speeding or a safety check that along comes a CBSA Officer demanding identification of your passengers in your vehicle?

The Canadian Charter of Rights and Freedoms section 8 states EVERYONE. ". Everyone has the right to be secure against unreasonable search or seizure."

The passengers that appeared to be ethnic minorities were asked for identification not whites.

"unreasonable search or seizure" So unreasonable that 21 people were detained.

63 now have been arrested in these sweeps.

Imagine you are driving a van which get stops and your legal passengers are demanded to provide identification and two have forgot their wallets so you are all detained for hours with no justification.

I agree with Roy that this tactic is objectionable. It is not only illegals who get caught up in this, it could be anyone who looks like they might not be Canadian born. That could be almost anyone. Arbitrary police action is one of the things we should not see in Canada and that is one of the reasons Canada is a destination of choice for so many genuine migrants. Most Canadians are proud that we do not have that kind of a system.

DocD is CBSA in Alberta

He believes because one person stole a candy bar all candy bars should be kept under lock and key. In fact he believes we should have to shop only on line and all malls and stores should be eliminated to prevent the potential of theft.

My clients got detained on this unreasonable search and seizure so that is enough for me to state it is wrong.

If they are your clients, it can only mean that their immigration status was not in compliance to our federal regulations.

Canada´s Immigration Act claim an objective of the Immigration Act is Family Reunification and Prompt Processing. IRPR 3 (1) (d) & (f).
