Subject: bat the apeal
  I got a departure order and still thinking to appeal or not... if i don´t appeal, i hv to apply ARC. Is that correct? then, i can stay in canada longer. If i go appeal, I don´t have to apply ARC, right? cuz my PR card is still valid until 2017. One more question, If I do the appeal, can i travel to other country and come back. Will that be a problem? (USING PR CARD)
IF i don´t do the appeal, then I use the tourism visa to get in to Canada. Will that be a problem as well??

How can you get a departure order if you have a PR card? Only permanent residents can obtain a PR card.

Now if you were ordered "excluded" for ie: misrepresentation you have the right of appeal to the Immigration Appeal Division.

Something in your post is not correct.

You got an exclusion order. That is the only thing you can get as a PR. You didn´t surrender your PR card. Here are the facts:

* You are required to leave Canada. You can appeal the officer´s decision and possibly defer your removal date but your chances are slim to none.
You were advised that if you don´t leave on the specific date, there will be a warrant for your arrest and then you will be removed from Canada.

* You are barely allowed to be in Canada(assuming that your departure date is in the future) at this point, never mind trying to re-enter. Read at the bottom of the exclusion order. That tells you about the "re-entry"

* Once you leave, either way you require an ARC.

Some of your replies makes me believe Canada Border Service Agency is not much about "service" and needs oversight.

An Exclusion order is for a period of time and after that time expires there is no requirement for an ARC.

Right, assuming that the person departs Canada within that period. If it becomes a deportation order, then he would require an ARC to return to Canada.

As for "service" what do you mean? We are not customer service at Walmart. There is the human factor that is heavily weighted in pretty much every decision but at the end of the day, you either are in compliance or not. That´s it.

People in real need, is one thing, people circumventing the system whom ultimately affect that ones that follow the rules, not so much tolerance for that.

Believe it or not, I am one of the sweetest guys that you will ever meet and I am also really really funny smiley type....until I catch you lying then things would drastically change.

Dear DocD

Take a look at the writing on Canadian Police cars. They say to "SERVE & PROTECT". American Police cars say "Protect and Serve".

HANDS UP DON´T SHOOT!

What timeline is set for a person to leave when issued an Exclusion Order??? NONE!

Any visitor that has overstayed can be issued an (exclusion order) if stopped in a traffic stop for example. Then in a few months be approved stage one because of an In-Land sponsorship application.

Nothing turns to a deportation order even if they do not leave.

No you´re not customer service types nor are any CBSA Officers customer service at Walmart because you guys lack the skill and compassion.

People get exclusion orders because they fall in love and time flies. People get exclusion orders because they work illegally so that they can feed their families here and at home. People get exclusion orders because they lie after being given bad Immigration advice.

So how many lumps of coal will, you be handing out this Christmas?

CBSA Officers are wearing guns sitting all day at their desks or telling a client that they have been approved stage 1 H&C.

Then Canada Border Officers want to be able to NOT wear name tags yet authorities in the US are talking about having web cams on their bodies.

Something is very wrong with CBSA!

Oh Roy, you are so full of warm air. It is nice to criticize things from the comfort of your chair.

People don´t get exclusion orders because they "fall in love" or "work illegally to feed their families" people get exclusion orders because they break the law, as far as I know hundreds of thousands of people get approved on a yearly basis as permanent residents, work permits and visitors but there is this 1% that figure that the law doesn´t apply to them, so stop being the victim, you are defending the un-defendable.

Based on your analogy, we shouldn´t have regulations then, labour market opinion assessments are unfair according to you and the thing about bringing people that contribute to our economy is over rated then. You´re really funny, it made my day lol.

Oh, all this is under the assumption that everyone is a nice little angel and people trafficking and drug smuggling is only an illusion :)

Sure that´s why an officer was shot in BC at the border crossing. We should take their guns away and give them a sling shot or better yet...give timeouts to the people that are armed.

"Something is very wrong with CBSA!" I am not too sure. The only people that tend to say that or disagree are the ones that constantly are finding ways to circumvent the system.
