The Law is the Law but is it providing fundamental justice?
Spousal Applicants who have applied in Canada based on their marriage are being removed from Canada. Some husbands/wives who have been married for four years or more after having their In-Canada application in for more than 12 months are being sent home.
Canada Border Officers are not questioning the validity of these relationships they are just saying it is time to go, apply abroad.
The objective of the Immigration Act is family reunification and prompt processing. The main reason these people applied in Canada in the first place was because they loved one another and did not want to be separated. Bad people they fell in love!
How is it their fault that after they applied In-Canada Spousal Sponsorship processing times for Stage 1 approval jumped to 15 months. Then another 8 months to conduct background checks.
Why does it take 1 1/4 years to open an spousal application and assess that application?
If an applicant does NOT get on the plane to go home............
CIC will continue processing the spousal application. If CIC decide that an interview is warranted they will call that person in to be interviewed. If successful at that interview they can get a work permit and stay while background checks are completed.
Or they can go home and wait another one, two or three years to be reunited with their loving partner.
Something is seriously wrong with this process.

In-Canada Spousal Sponsorship (in reply to: In-Canada Spousal Applicants being Removed!) Hi Roy,
I was sponsored by my wife under the family class. I have two questions:
1. I first submitted the application on August 5, 2014 but it was returned due to incorrect form used but it has application number when I got the whole application papers that was returned. My question is, does the processing time starts from there? or the time that I got the file number when I corrected the errors and received the confirmation e-mail on October 16, 2014?
2. My temporary work permit expires on January 17, 2015. Do I need to renew or apply for a work permit and when is the right time for me to do it?
