Subject: Do they keep the passport after the interview??
  I have a query!! Do they keep the passports of urs, after the interview, in case of spousal sponsorship?? I have been hearing some news that they dont keep the passports after the interview?? My visa post is New Delhi. whether u succeed in the interview or not, do they have to keep the passport, or will they return it?? The interview letter that i got asked me to bring my passport, but i am asking it becuz i heard it somewhere that they return the passport. Whether approved or rejected, do they keep the passports and if not, why i have been asked to bring mine along, to the interview??

Hi Amy..I see that you have a ineterview for March 3nd at New Delhi concerning your spousal sponsor aplication...I am wondering,,did you apply for your CAIPS note?s before hand,,,so you would have a good idea what the visa officer?s concern?s where in your case... My husband went threw this spousal interview threw New Delhi office,,and it is not very easy to have a good interview at New Delhi..I know every ones application is different,,but if they are calling you in for a interview,,the visa people have already writen down concerns in their notes,for the interviewing officer to check you on...I know this,,because i have applyed for the CAIPS note?s of my husband?s interview..I wish i would of applyed before hand,,but really had no idea to do so...My advise to anyone who has to go for a interview,,is that if you have the time,,then get your CAIPS note?s..They will be well worth it in the long run....Good luck to you on your interview....Lily

P.S..The interviewing officer after my husband´s interview threw the passport at him after the interview,,so the answer is yes,,you get your passport back fast if you are refused ..If you are not refused,,i heard that they will keep your passport,,and maybe you will get it back in a few days..But this is just hear say,,i really do not know..I would thikn that if all the fees are paid upfront,,then you would get your passport back within 1 or 2 weeks..

why was it that way lily!! i dont understand why ur husband was refused?? did u not know him before and if u did, did u not provide enough proofs?? i wanna know it

Hi Anonymous...My husband had his interview on Nov 2004,,only a few months ago,,and the visa officer was very rude,,and all most angrey like with him..She even pointed her finger at him at one time,,and told him to stop telling her a story,,.He indicated on the application,,that he wanted his interview in english,,but she kept asking him if he wanted a interpertor,,he said no at first,,then finnaly he thought that he would do as she asked,,maybe she would be ok with him..But after that all hell broke lose..Yes i have recieved the refusal letter,,and i have already sent in my appeal into the IAD in Janurary..And yes i know it is going to be along time for this appeal,,because i have phoned to the IAD and talked to them about how long it would probley take to get a hearing...In his last week,,i recieved the CAIPS notes of the visa officer,,i had sent for them myself threw Canadian office here,,and it took 5 weeks for them to get to me..Really,,i can not even believe that in these notes are mistakes..I have not hired a lawyer yet,,as i wanted to get all this information first,,to see what i am dealing with..My husband seems to think i am a lawyer,,as i have picked every untrue word apart that she has wrote in the note?s,,and also the refusal letter..This visa officer has errored in law and fact,,and has also been very bias in her note?s,,and also the caips note?s concerning me..My husband has been married before,,and i have never been married,,but lived common law for 15 years to a previouse partner..Me and my husband knew each other for 3 1/2 years ...I went to India we got married,,the visa officer is even saying our marriage in not valid because my husband is a hindu,,and i am a christion,,and because we did not get married according to the customs,and ritues of my husbands community..But then she goes on to say,,that even if we did have a traditional ceremony,,then still our marriage would not be valid,,because i did not convert to hinduism..But that is all ok,,we did not get married under the provisions of the hindu marriage act 1955 ,because of course i am not hindu,,,we got marriaged under the provisions of The Bombay Registrations of Marriages Act 1953,,which indicates in the rules of it,,that to contract a marriage,means to solomize it in any form or manner..This marriage act is in Gujarat State..You see we had a very small and fast ceromony ,and exchanged rings,by a priest on one day,then we went and registered the marriage at the registrar office,,,and then a few days after,,we had a beautiful reception with some tradition ritues there, we hired a photographer,,and a guy to do vidio,,mine you it was not a big gathering,,but it was at a very big and fancy hotel in Ahmedabad..I stayed in India for 5 weeks,,wow,,i just loved it there,,it is so different then Canada that is for sure..Anyway,,the long of the story is,,that with all this ,the visa officer still refused my husbands application,,but the worst thing was,,she said our marriage was not valid,,so in that my husband is not my spouse,,and she also said our our realtionship was not genuine,,because she said my husband did a divourse of convience with his wife,,just so he could marry me,,and get into Canada..Even tho him and his wife was seperated for 6 years before they got a divorce..All my family here can not belive this,,and all my husbands family and friends can not belive this..Anway,,we have gathered so much new material on this all,,my husband even went to his govermnet there in Gujarat to request as much information on that Bombay Registration Marriage act 1953...We have to show proof now that this is a legal marriage..The one thing i can not understand,,that how can 1 visa lady make her oun rules about marriage there in India,,and also how she can make her oun rules in how she conducts a interview..I have read the rules,and regulations that a visa officer has to abide by,,and let me tell you she had broke alot of those rules in our case.. Now Anonymous,,what do you think about that...lol..Lily..

thats not a good thing fr a visa officer to do?? was she white or indian or wat??
i think that such visa officers should be dismissed

amy,,please do not go into your interview with the thought because you are married,that it is going to be easy for you to get your visa..I do not know your circumtances of your marriage with your Canadian spouse,,but if they are calling for a interview,,then they have concerns about your and your wifes realationship..Please be very well prepared for that day...We had taken it to lightly,,there was alot of people who told us that it is a rare thing for them to refuse a spousal sponsor apllication,,so we had no idea this would happen,,,I mean we send proof from 3 1/2 years contack,,i was in india for 5 weeks,,and oo so much more..We were in a state of shock from the refusal that day..I mean me and my husband love each other dearly,,and i am sure the visa officer seen this all..But instead of judgeing me and my husband on our love..it seems they judged us on our different cultures,,and different background,,and thing like that...Really hard to belive..But that is what happened..Please be prepared for your interview...Lily

The visa officer was a indian lady,,and in our thought,,she was very set in her culltural thinking..Really,,we did no have a chance,,that is how i see it...Lily

i know that this is really appaling!! and i would take ur advice and not take all this lightly!
we r of the same culture and we have been in contact with each other fr the past almost 2 years!! we have huge phone bills and emails to support our documents! i was in england and she was in canada and we kept out relation alive. no one out of us has ever been married and we got married under hindu marriage act, 1955.
i am not saying that this woud give me a visa, but i dont see a reason why they will refuse?? God help!!!! i am prepared

HI really do not know if this visa officer was a Canadian permanent resident or know..How would one ever know if she was..My husband was not allowed to even ask her any questions,,she told him, when he tryed to asked her a question directly,,she told him he had to talk in his mother tounge,,and not to her,,and to only answer him,,not to ask her anything..

amy!!,,your marriage sounds straight forward to me,,i am surprised why they have called you in for a interview..There must be a few concerns,,please try to thikn what they could be,,so you will be prepared for anything that the visa officer will throw at you...
