i read your note there as i have told you that visa officer can decline the case on the basis of compatabilty which age , religon and lot of other things Any time there is an interview in new delhi office it means the case is dead , its not you its with all other applicants too they have already made the decesion , dont waste any time hire good lawyer dont take any risk as you have to proof to the immigration officer , your file will go through adr

HI Anonymous..Well i am not so sure that it was not with me that visa officer had a problem with,,In the note´s and even in the caips note´s,,this is what she write´s a very bias statement.....((that i was in a realationship previousely with my x partner for 15 year´s,,and i did not feel the need to marry at that time,,so why get married now))..can you belive that...I do realize that many person in India do not like the idea of doing divorse there,,so maybe a bit of a problem in that alos in her mind..The rules set out for a visa officer say that they are sopposed to keep a very open mind when they are acessing a application,,but if one is so strongling into thier cultural think,,then how can one get a fair interview...

so where are you located i mean to say we can meet i can tell you more about it , but try to hire a good lawyer you are looking yourself sometime in sept for the appeal date, also just an fyi you should have hired a lawyer before you have made an appeal that would be much more easy for you

HI Anonymous..Thanks for the offer to help..I am thikning to hire a lawyer..But there are many people who do not use a lawyer..I have met with my MP person here,,and he knows all about my this problem me and my husband are going threw..I have done so much research on this all appeal,,and every rule,,and just about eveything there is to know about appeal cases..I have read many many appeals cases,,and accually know quite a bit about them now..From reading appeals cases,that are listed on the IAD website in reflex,,one get´s a very good understanding of all the issues that one has to deal with in this kind of wrongfull desision that a visa officer does,,really there are so many other people in the same boat as myself,and my husband..I am curiouse about you,,,you seem to know alot about this kind of problem,,,have you also been refused,,or are in the process of this all terriable immigration process??...What i plan to do is to gather,,and get as much information as i can,,and send a copy of the caips notes,,and point out everything that is wrong with this all visa officers notes,,really almost hard to belive the mistakes..The best thing is that our application itself,,can give proof that some of the visa officers notes are a mistake..I will not stop until something is done for me,,I will send ,and send,,and send until i get a answer to that how can 1 visa officer do errors in fact and law,,and also be very bias toward me,,and how can that be correct..I mean me and my husband have to pay the price of time,,because of some visa officer errors...I am sure alot of people are also paying the price of thier time away from thier loved ones,because a visa officer has errored in law and fax in thie case as well,,If one takes the time to look carefully at thier refusal letters,,and also to get the caips notes,,,really and compare them,,it is easy to detect such things..Read,and read,,and reread,,..All this being said,,still it will be along wait no matter what one does..I will say one thing,,the driving force of love,,will make one do almost anything....Lily

i understand where are yu coming from but i will still advise you to go through the lawyer, dont fight your own case because you dont know all the sections and law , go to appeal board listen to the cases , having a lawyer makes a good impact on the minister counsel , also go to india in between to show them that you cannot live without each other , this will really help
by spending 4000 to 5000 dollars on a lawyer will definately help you , otherwise if you loose again you have to take it to federal court which again will take 4 to 5 yrs easily so dont take risk , i have gone throgh the same process myself

Now dude... is this for real or what??

I mean 15 years in Canada and still can´t write in English. If I were an immigration official I´d reject the case just on that basis...

Thanks Anonymous for your advise..I will take that into concideration about getting a lawyer...You know when i first got the refusal letter,,that was the first thing i was going to do..Then i got in contact with my MP of parlament,threw his contact person in my area...I had a meeting with the MP,,and also with the contact person..She told me that there are many people who do not have a lawyer in thier appeal cases..This lady will be coming with me the day of my appeal..Did you have anyone helping you in your appeal case??..Did you hire a lawyer for it??..It is good to get a idea on the out come of other persons case´s...I have planned to go back to India in this year..But i am afraid if i do go back for any length of time..I will lose my job,,and also i will not be able to open my bussiness in the summer months..You see if i do go back,,i know i will not be able to leave after just a few weeks,,really i had a very difficult time to leave after my 5 weeks stay last year,,But i knew if i did not come back,,my job would be gone,,and also my summer bussiness would be gone..What do i do??..I really do not know what to do in that sence..Anyway,,at the appeal,,if they tell me that i have lost the case,,then i will tell them i have no choise then..I do love my country of Canada that is 100% for sure..But i love my husband alot more..So that means at that time,,i will sell everything i have here,,and quit everything,,and move to India..I told my MP person that also,,he told me that i would never have to do that..But if i have to do it,,then so be it....OO that driving force..Makes one do anything....Lily

you sound to be stressed out here , if i can somehow give my phone no to you , i dont wnt to post on the site , so i can tell you what you have to do , going through a lawyer is the best alternative , where do you live i am in toronto how about you , mp wont go with you you will go through a informal hearing and if you loose the case than you will go through appeal and then if you loose there you have to apply in the federal court , they will ask you that question the the appeal you answer is right that you will go baCK TO INDIa , they all they wnt to know how strong your relationship is , yes definately go to india fo for 2 or 3 weeks once you get your date but please hire a lawyer if you hire at a later stage you still have to pay the same amount of money so why not right now
also i will keep my fingers cross for you you are not in the same boat there are lot of other persons who are even in worse scenario than you
look in the yellow pages or in metro they advertise lawyer services

Hi Anonymous..Thank you again for your advise..I have already wrote down a few immigration lawyers name´s and address´s that i think would be good to use..Like i said,,at the very first when i recived the refusal letter,,that was my intentions to do...But i soppose my contact lady to my MP changed my mind on that..She told me she would help me with this all,and that it was not nessary to get one..But still somewhere in the back of my mind,,is the idea to get a good lawyer..Thanks for your advise..I live in Nova Scotia..I soppose when i said there was other people in the same boat as me,,i had met that other people who were seperated from thier loved one´s because of this not so good immigration system,,of course all cicumstance´s are different in every case..But still the fact is we are not with our loved one´s in one way or another because of this immigration system....I am interested,,are you a guy,or a gal?..If you want to contact me directly im me on yahoo messenger if you have that.. garden_girl_36 Thanks again for your advise..Lily

i am guy and i wish you all the best , immigration system is corrupt , i dont know where are you filing the appeal , do you have a appeal board in novia scotia whats the time there , in toronto it takes 8 months to 1 yr and then your file goes back to new delhi which means new medical new police clearance i am trying to prepare you

Hi Anonymous..Thank you again...The the IAD office that i had to send my appeal to is located in Montreal...I had phoned there,,and they told me it take´s aprox. 4 months for them to get the appeal record,,and then aprox. another 6 months wait until i hear something from them..She told me that was the general amount of time...I have not went threw this all process yet,,but like i have said,,i have phoned,,and read,,and phoned,,and read so much on this all..You know,the information that is on the IAD website tells all steps one has to go threw,,,even what to expect in the appeals hearing..If one is lucky there case will come up a bit earlier in the ADR program..But who real knows..I think it is best to have in one´s mind that it will be more then a year to have thier appeal case heard..That way,,if it should come in a early review process,,then one will be pleasently surprised(( Ya right,,like that is going to happen))..I have just ordered a fax copier machine today,,should be here sometime tommorow,,so watch out all thos immigration offices..lol..Just joking,,but it will be very usefull to me in this all...Yes,you are correct that my husband will have to get his medicals and police check done all over again..I have already told him that..What a pain this all is,,and also the extra money this all costs,,and also these visa refusal not only cost us,,they also cost the Canadian goverment aprx. $2000 for a single appeals claim..But really it is the time factor that is the real cost to people whho need to do appeals..The time that one is seperated from thier loved one is the worst..Really,unless you have gone,or are going threw that,,then that is the worst pain i am sure,because it is like we have no control over the matter..The wanting to be with someone,,and not being allowed to be with them is almost unbearable at times..OO that driving force..it will make one do anything...Lily
