  i understand the seperation and the period of time it will take , i also know you dont have any control over it ,this i can tell you your case will go through adr thats the very first step and if you dont pass in adr than regualar appeal and than federal court , but i am pretty much sure you will do good in the adr but do take a lawyer with you dont take any risk it cost you 4000 dollars but hey any kind of a sacrafice at this point is more important to you
what kind of quotes you are getting from the lawyer
also tell me if you will go to montreal for it thats another expense , you are looking for 1yr and 4 months easily for the whole thing to go through

Good day to you Anonymous!!! Thank"s for your advise again...I would think that if i do have my meeting with the IAD,that i will probley have it for Halifax..I would not think that they would subject me to go all the way to Montreal for that..I do believe that they have different way´s of dealing with the distance factor in these case´s..I have read about the teleconference,,so possabley that kind of set up in Halifax..But if i have to travel to Montreal,so be it..I soppose i will travel to the end´s of earth to prove my case..If that is what it take´s..lol..OOOOO that driving force,,it will make one do almost anything...
I am curiouse about you Anonymous,,Are you waiting for your partner to join you in Canada,from some other part of the world...You seem to know alot about this immigration racket,and what all it intails...I hope you are having a nice day there..Lily

yes lily i am definately my partner to join me in canada and we went through the same process you are going with , so i know how you feel about , finally our case was done in the first meeting it took me almost 1 yr , i hope you will do your best to have this finished within the first interview but go with lawyer dont take any risk , keep on writing so i can guide how you should handle it
i know you love your partner the way you write and you cannot live without him , but be patient , now you know it takes time , go to india visit to make this more stronger and dont try to develop over confidence because at the time of an interview with minsiste counsel , you really have to proof by bringing tears in your life that stupid mistake from the immigation officer have costed you more than a yr

Thanks Anonymous for the offer to guide me in this..Really it is so good to get advise from someone who has already went threw this appeals process..Really,,this forum is so great in it helps people connect with other people who are going threw,,or have gone threw this terriable immigration ordeal..Did you hire a lawyer who specialised in immigration??..When you went to yur appeals ADR meeting,,how long did the meeting take,,and how soon after the meeting did you find out if your appeal was allowed??..Did they tell you right there after the meeting that your appeal was allowed??.Was the CIC counsel person very hard on you,,did they ask you alot of questions??..Did you send very much new information to the IAD office before your ADR meeting??..Last question,,are you a permanent resident who sponsored your spouse from another country??....NO this is the last question to you,,are you still sure you want to guide me threw this ordeal,after all the questions i have just put to you..lol..just joking...Tipical woman aaa...I hope you are haveing a nice day there...Lily

whenever you have a chance to come to toronto you can see me i am canadian citizen been here for almost 14 yrs , my file went through adr (you can call this as a interview)this last for 1hr to 2 hr , it is done with the minister counsel and dro and yes ofcourse i went through this lawyer taking lawyer with you means that you are spending money and this is not a false case , it gives lot of strenght to your case, although lawyer does nothing in the interview he or she prepares yu before adr conference , he sits there see you beign inteviewed properly and if minister counsel ask you wrong question he can interrupt so hiring a lawyer is a essential in your case becuse he knows the rules and sections which sometimes minsister counsel have no idea
Mine was not a heard interview , they try to confuse read your face and i am pretty much sure you will successful in the first attempt only, yes you have to take all the document again, after the refusal you should keep more touch with your spouse proof eg phone bills emails and other stuff you should carry and when you go to india take more family picuturs , go on honeymoon again keep all the receipts
i wish i can meet you in person before your adr come through and tell you exactly what you should do
now since we have become good friends (although we dont know each other´s name ) we exhange our phone nos and constantly in touch with each other
My wife is coming by the end of this month or beginning of next month
you are a very nice person , i will keep my fingers cross for you

Hi Anonymous...OOOO you must be so happy that after all this time that your wife is going to be here soon with you..You know it makes one feel so good to know that other people acually do, get threw this long ordeal with the immigration and appeals process..In a way it give´s other people hope and courage to continue on thier long journey threw it..Can i ask you what was the reason the visa officer refused your wife´s application for permanent residence??..You know me and my husband have contact in one way or another every day..I have 1000´s of emails,,and also proof of 1000´s of hours of talks with him..And also many phone call bills...I have many photos together..Really there is so much,,and you know,,that was one of the things that the person at New Delhi who did the paper screen part of the process,,it was indicated on that,,that there was proof of sufficent amount of contact from all that i sent in with the application..emails,photos,phone bills ect..It almost seemed that they knew we were in love,,but that the visa officer tryed her best to make everything we had that was posative,,into nagative..Still hard to believe...Do you have a email address??..If you do,,i can send you a few photos...It is always good to put a face on who you are sending all this info. to...I really do appeciate all the information you are providing me..I hope all the best for you and your wife when she get´s to Canada..I hope you are having a nice evening there..Lily

those indian girls who takes the interview are not good person at all , they turn all of us down purposely , they are jealous of us because they cant come to canada , actual canadian immigration officer does nt come out side to conduct interview and they believe these front line clerks who actually take the interview
mine was turn down because they said the marriage was not publicize , and my wife told them that she was,nt sure that we have to advertise in newspaper to publicize the marriage , clerk was taken by surprise and she turned her down at the same time

All proofs after they turned your husband down make a seperate file for it , if you can even give birth to his child (i dont know if thats ok with you ) that lays very solid foundation and it shows the major proof that he is your hubby
i cannot put my phone no here i have no idea how to get in touch with you , also i dont understand why iam so interested in your case so much because yours is exactly the same like me 1 yr before , so may be by helping you god will speed up the process of my wifes coming to canada

Hi Anonymous..Good day to you!!!..Your case does sound simmilar to my and my husbands..So that clerk who conducted your wife´s interview said that you and your wife´s marriage was not a valid marraige,,because you did not give 30 days notice before you got married..I have read alot about the different marriage´s act there in India,,and i know the Hindu Marriage Act 1955 does not require this 30 day´s notice,,and also the marriage act that i got married under their in India,does not require this 30 day´s notice before marriage..Bombay Registration of Mariages Act 1953...But there are other marriage act´s there that do require this notice of 30 day´s..I have done so much research on the different marriage´s acts in India..Really,,there are so many of them,,and also along with the marriage act itself,,is one´s person laws..Really,,any person who did not know all this,,well really make one´s head spin with all these different rule´s and regulation´s concerning marriage there in India...I sure wish i had known all that i know now,,before i went to India....Here is my email address,,if you would like,,please do email me..I think our refusal case´s could be similar..I am so happy that your long wait is nearly over,and that your wife will soon be there with you...How many month´s after you won your appeal,,did it take for your wife to get her visa to come to Canada??.My email address is garden_girl_36@yahoo.com Have a nice day there..Lily

she did,nt say about the notice all she said that marriage was not advertised , we never know we have to advertise in the newspaper
lily processing of my wife is still going ahead , she has done the medical again it was declined last yr in march and we still havent got the papers so you can understand the time it takes , also please note yours can take more time because you might have to go to montreal, making research on the marriage will not take you anywhere , because the minsister counsel will believe the notes from immigration officer , her decesion is the fianl decesion ,no body can challenge them except the lawyers

Hi Anonymous...How many months was it from your wife´s refusal last march,,until you had your meeting with the appeals ADR..Was it just a short time ago that you had your appeal meeting??...and your appeal was allowed??..My husband has also went to the Gujarat Govermet Head quarters and talked with the Gujarat Governor,,and got official documents from them concerning our marriage act??.He is now dealing with a lawyer who is also getting him information...He has gotten affidavits from his Caste President also,and also from lawyer´s there,,and the priest who do our marriage..Also another thing we have get done before i left India was we went to Ahmedabad Passport office,,and my husband got his old passport canacelled,,and they issued him a new one with my name into it as his spouse..Every person in Gujarat say´s we are married,,and the registrar person told my husband,,that if we need a divorce,,so that we can remarry again,,according to what ever rule´s the visa office belive´s in ..Then we have to go to India court,,and apply for a divorce,,before we can have one..Really,,what do you think of that..If our marriage is invalid,,like that visa lady say,,then why would we need to go to court,,and get a divorce like that..Anyway,,so what i do not understand is this,,that how can 1 visa person,,say all this incorrect thing..There is proof just on my caips notes,,that there is mistake´s done ..I mean when person see´s this with thier oun 2 eyes,,then how can they know that all what visa officer say´s is true,,I mean when you make easy common mistake,,then how could a person ever think this visa person is ok to make a very important decision such as wheather one´s marriage is valid,or not valid..And how i understand the rules and regulations set forth in this appeal´s division,,that if there are any errors in law and fact in any case,,then there is no way that a person would get a fair interview,,or a fair acessment of thier case..Any person who looks at my caips note´s sees all errors very easily...lol..ok..now i am finished,,,sorry,,i can go on and on,,as i am sure you have already got from all i have wrote you about my and my husband´s case...So how many months was it,,from the time of your wife´s refusal,,untill you had your ADR meeting,,and they alllowed your appeal??..I was under the impression that it would take a year,,to just get the date of your appeals meeting??..So you had your ADR meeting within a year from your wife´s refusal date..I know that is still along time for this all to end,,but i thought these appeals process was longer then that...It is good that your wife will soon be with you,,,really not good to be apart for so long..OK..bye for now......Have a very nice day there...Lily

please keep on writing so i can tell you everything , my appeal was allowed in nov that was in 7 months from the time of refusal and it was for adr and they sent the papers back and we again have to do an application medical pcc
your hubby does not have to do anything in gujrat like meeting the governer , gettting all the proofs, it will have no meaning , your case is in your hand , hire a decent lawyer and go through an hearing ,i am very much confident you will win in the first attempt, dont stress yourself , all its going to take is the time , my case still going through , i dont know how much more time it will take but again life does,nt end there

HI..Anonymous...I have thought that it would take more then a year to get a appeals hearing date,,How many months was it after your wife´s refusal,,that you got a letter from the IAD saying the date of your appeals ADR meeting?/..I thought it would be much longer then 7 months??...And what was the reason in your refusal letter that they refused your wife,,there are many different grounds for a refusal,,our refusal was first,#1,,me and my husband did not have a valid marriage,,and then also #2 was our marriage was not genuine..So the visa officer gave me and my husband a double wamy,,meaning we have to prove 2 different issues..Really hard to belive,,but that is what she did..I belive she did not like the fact that he was previousely divorced,,as i know many person in India are against that idea,,exspecialy women..I never like to judge any person in any way,,but i soppose in this case,,i have no choise..Many people told me,,when they seen our photos,,that this visa lady was very jeliouse of how i looked,,and all that also..Really our photos were very nice,,even if i say so myself,,even my MP person told me that maybe this lady did not like me,or how i looked,,,silly really the thought of that,,but my husband said that from day 1 after his refusal,,that this visa officer was very jeliouse..Anyway,,all this information my and my husband is getting,,will be of some help in this..But i will now get my oun lawyer..Really,,i had thought this would be more then a year to just set a date for the appeal meeting..So that i would have alot of time to think to get a lawyer..But now i am thikning i better soon do that..Always in the back of my mind was to do that,,and if that contact lady to that MP had not told me that i did not need one,,then really i would of had 1 by now...So from the time of your wifes refusal,,until the IAD set yu a letter telling you the date of you ADR hearing was how much time??..Lily
