  Normally it takes 7 months from the time you file an appeal , also they have to check the lawyers availabilty
yes mine were the exactly same reasons but after appeal is been allowed it takes another 6 months , i am talking if you were to file your appeal in toronto any where outside i cannot give you any timeline, normally in my case its the lawyer who filed the appeal and thats the way it should because they have to sent the request back to new delhi and they send a copy of your record to lawyer automatically , copy to you and copy to the appeal board, it also tells chc new delhi you have now a lawyer to represent your case,
please tell me where did your hubby went for an interview is it new delhi or some other place

HI Anonymous,,My husband had his ineterview at New Delhi last Nov..After i sent the appeal into the IAD in Montreal,,then i phoned to them,,and asked them also some questions,,the lady i was talking to , told me that now, the IAD office sends a request to the CIC for the appeals record,which comes from New Delhi..When they get that record,,and also i will recieve a appeals record ...Then after aprox. 6 months i would hear from them again,to set my date for hearing,but this was a general time frame,,as all IAD office´s have different amount´s of appeals..So really i do belive,,that one can not really judge the time frame from one IAD office to another,,One could have more appeals then the other..So some case´s could go much faster then other´s,,according to where one live´s....Where you asked for any additional evidence or documents before your appeal hearing,,to prove your case??..I have read that before one"s hearing,,if one has other documents to show at the hearing,,that they need to send a copy of these papers,,1 set to cic,,and also another set of copies to the IAD??..Did you or your lawyer do this before your hearing.,and if so,,how much ,and what kinds of thing to you tsend to them,,and what all thingsdid you take with you to that meeting..??..Lily

yes my lawyer sent everything to the appeal board before the hearing everythign means gifts , phone bills pictures honeymoon pic family pic but it has go through the lawyer
you did a mistake at the first level by filing an appeal yourself , i dont know who suggested you but that was not right path, orginal request for the appeal should come from lawyer becuse his name goes everywhere even to new delh as he will be getting the record too so visa officer actually know you have hired a lawyer and you are spending money and this creates lot of impact on them,
Now what will happen when you hire a lawyer you have to write a letter to the appeal board that you have hired a lawyer and it creates lots of confusion
Time it takes to get an adr could be faster in yur area so your processing time could be different from mine

HI Anonyomous..So what you are saying,,that if it is shown,,that in some way,,that i have spent alot of money in my case,,that will look favoriable in my case,,because everyone knows that to hire a lawyer cost big dollars...So you are saying that the IAD member´s,,and also CIC counsel will look,,and thikn that this lady has hired a lawyer,,and she has spend all this extra money,,,so this realationship must be real,and true..Is this what you mean??..Lily

all it tells them this is genuine relationship and you do care for your partner, you can do anything to get him there ,money is not a concern
See lily right from the day one i am telling that you should go for a lawywer , i will not get anything out of it all its that i cared about you because i know it feels
Do not take any chances (this will again put you a one yr behind)i have hardly seen in the appeal board any cases without lawyer as i have listened to lot of cases myself , having a lawyer is definately right thing , I am your well wisher and i dont mean anything wrong to yu , i lknow it costs money but there is no other alternative except going by yourself which means taking lot of risk because as i have mentioned to you earlier MINISTER COUNSEL WILL BELIVE THE NOTES WRITTEN BY AN IMMIGRATION OFFICER , YOU HAVE TO ADDRESS EACH AND EVERY OBJECTION HE PUTS AND HE CAN EVEN ASK WRONG QUESTIONS TO YOU , AT THAT TIME LAWYER CAN INTEVENE

HI Anonymous..It is very interesting what you have say about the money factor..Really,,i think when the IAD take a look at my and my husband´s case,,then they will think,,that yes,,this lady has spend a considerable amount of money already,,.I know you do not know the full of my and my husbands case,,But i will say,,if the visa offier took the money factor in when she was acessing the case,,then she would of gave my husband his visa that day..I will do some phone calls and check out the lawyers in my area..Did you get a lawyer,,that was a expert in the field of immigration..There are some lawyer´s that specialize in immigration,,and then there are just regular lawyer that do many other kinds of law??..Lily

i think so i am not able to proove myself its not the money , its going through a lawyer now that lawyer could be your friend or relative , its the impact lawyer will made the case , no i dont have any lawyer the one i went with him, lives in toronto
also please let me know which date exactly did you filed an appeal , looks like its been 3 months almost , i mean to say you are half way
see i treat you as my friend , i dont know about yourself but again keep in touch with me

HI Anonmous..What was the name of your lawyer??..Or the Law Firm that he works for??..Maybe they have connections in Nova Scotia..I can look for it online..I sent my appeal into the IAD the middle of January,,and at the end of January i got a letter,,saying my case was in process..So really,,only a little over 1 month has gone by sence i sent my appeal..I am thinking that i probley have plenty of time still..It is still very early in my process..hanks for all your information,,it has put a new light on this all for me...Lily

may be it takes faster in nova scotia , my lawyer does not operate from there , otherwise i would have told you upfront

Thank you so much Anonymous for all the information you have provided me with..I sure do appricate it..I will contiune to post all my information,,and how my appeal goes on this forum so other people can benfit from it..Thanks again,,and i sure hope your wife get´s threw the last stages of her application there soon,,so she can be there with you...Right where she belongs...Lily

OO My Gosh Anonymouse..No..I did not mean that..Really you are a person who has gave me so much usefull information..I was thanking you,,and also indicating to other´s on here that i will also post my appeal process so they can benifit from it..Really,,i feel like you are my friend now,,so of course i still want to talk to you..I would like to get a good understanding of this all appeals process,,and the best way to do that,,is to talk to a person like you,that has already gone threw,,what i am going threw now..I am so lucky to have found you on this forum...Can i have your first name,,or a nick name for you,,as really i do not like the name Anonymous...lol..sorry about that..Lily
