Subject: Fiance/Visa or Spouse Sponsor
  Hi all

I need some advise. This is our situation. My fiance is from the Philipines but she has been granted resident visa status in Canada if she enters Canada before July 29th. The thing is that she has to be in Canada for 3 years before she becomes a canadian resident, right?!

Meanwhile her documents were processed she met me. We are now engaged but are unsure about the future. I am Danish living in Hong Kong togehter with her and her 11 year old daughter..

How do we approach this matter in the the correct way? My interest is to stay with my loveones and go with them to Canada, to get a working permit in Canada. Can she sponsor me already Or does she have to be a canadian resident first meaning she cant apply for sponsor for 3 years???
Does the Fiance visa still excist???

Hi

I´m not sure whether this advice is the best or not, but here it is

Let your Fiancee go to Canada and land as a permanent resident.

You can follow her to Canada, but SEPERATELY. I think that because you are a Danish citizen, you are not required to apply for a visitor visa to Canada.

Once both of you are in Canada, you can get married. Remember to keep all proof of your relationship, including photos, proper ceremony, dates of where both of you first met etc.

Pursuant to a recent change in Immigration policy, your spouse can sponsor you while you are in Canada; you´ll not be required to leave the country. I think that Immigration Canada would grant you approval to stay in the country until the case is decided; you´ll have to confirm this point.



As for your other point with regards to 3 years´ stay. It´s only a requirement if a permanent resident intends to apply for citizenship. However, a permanent resident is allowed to sponsor their spouse. Being a Citizen does not make much difference in this respect.

I´m not exactly sure on this BUT... I was under the impression that someone who has permanent residence MUST be a resident for something like 720days before they can sponsor anyone.

As for the 3 years you must be a resident living in Canada for 3 years out of a 5 year period to apply for Canadian Citizenship.

Your best bet would be to work your but off trying to find a company that will be willing to go through the work of getting you a work visa. It will have to be confirmed through HRDC, which can be tough. Do you have any incredibly specialized trades? THey love those. Alternatively you could come to Canada as a ´visitor´ for 6 months to try to find companies to offer you a job. However when you 6months run out in all likelyhood they will not grant you an extension on your visa because your wife/fiance is not eligible to sponsor, since she hasn´t been a resident for the prescribed amount of time.

You case is pretty complicated and you might benefit from the assistance of a lawyer, or similar.

Also since your wife/fiance has a child she will be forced to show proof of funds, I think its like $10,000Cnd. I know its more than that if shes wishing to sponsor you too, since she is with child.

Anyhow... long story short... read read read and research on other Danish people and their success with immigrating to Canada.

I´ve been doing research on spousal sponsorship over the last two years, on behalf of myself and relatives, however, I have not come across any rule that that requires a permanent resident to be resident for 720 days, before they can sponsor a spouse.

However, there is a rule stating that if the sponsor is not eligible to sponsor a spouse, if they have "previously sponsored another spouse, a common-law partner or a conjugal partner and three years have not passed since that spouse, common-law partner or conjugal partner became a permanent resident."

Another thing, the financial requirement for sponsorship of a family class member, is not applicable to spousal sponsorship. Again, for full details, refer to the above link.

I must repeat that you are allowed to stay in Canada during the duration of the immigration application (only limited to spousal sponsorship). Please see link

Therefore, there is no need for you to get a work visa, for this purpose. However, you might need a work permit, simply because, you would want to be earning some money, while your immigration application is being processed.

Another thing, I need to clarify. An Immigrant becomes a Canadian resident, once he/she lands in Canada. They can apply for Canadian citizenship after 3 years of stay over a five year period.

hi there i hope you are in good shape .....
am canadian citizen living in toronto and my fiancee lives in sydney and her legal status is permanent resident since she arrived to australia three weeks ago as newcomer ..
so am planning to travel down there for marraige ceremony in order to be able to bring her to canada to live together as married couple .so my question ? what is proper documents and proofs should i submit to the canadian embasy for this application to be processed so she could be granted visa .or do you have usful information or advise you could help me out in any easiest way you find it better for me .....thanks alot in advance.........

i need an advice and i hope that you will give me some answers. i am macedonian, and my fiance is canadian citizen who has a private business in toronto. for the last five years we were apart because of my studies. now, after five years we decided to get married but since my fiance had already has a business in toronto he wants me to follow him there. we plan to get married in toronto as soon as a receive that kind of fiance visa. honestly i have no idea what kind of dokuments i should prepare for that kind of visa. my fiance told me that he already consulted some loyers there and they told him that everything what i need is my passport. is this true??????? of, course that he will send me all the documents he needs to prepare for me. we find out that this kind of fiance visa is the fastest way to obtain a visa and be wit my fiance. at the moment i am in belgium, and i have to be here till the end of february 2006 and after this i plan to go in canada. if everything is ok with the papers if there is a chance to be there in the begining of march 2006?????

ive been reading your messages as i also have some complicated issues how i can get my girlfrend here in canada. we are both no longer living with our husbands and wives, we both have children. she is currently finishing her care giver course to get work here. my question is if she comes here as having an employer with a work permit can we get married here in vancouver during her employment? or do we have to start with the divorce process first?

can we get married in hong kong/macau then can i sponsor her as my wife and no longer come here as a care giver?

ive been here in vanc for almost 1 year now as an immigrant and my wife & son lives in toronto. me and my wife were separated already for over 3 years the same time i was applying for our immigrant status then.

please i need some advice, i just need to know the proper way we can be together again, we wer already living together in the philippines almost 1 year before i left, got her pregnant 4 months before i left but had a miscarriage.

i hope i can get some advice from this forum, it would really give me some perspective. its so hard to be away from your loved one...
